MEYER , KRESSIG , and BAGNIEWSKI A BILL FOR An Act concerning benefits associated with cancer diagnoses of 1 members of certain public retirement systems. 2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 3 TLSB 1703YH (3) 91 sc/ns H.F. 267 Section 1. Section 97A.1, subsection 6, Code 2025, is 1 amended by striking the subsection and inserting in lieu 2 thereof the following: 3 6. Cancer means a group of diseases involving abnormal 4 cell growth with the potential to invade or spread to other 5 parts of the body. 6 Sec. 2. Section 411.1, subsection 6, Code 2025, is amended 7 by striking the subsection and inserting in lieu thereof the 8 following: 9 6. Cancer means a group of diseases involving abnormal 10 cell growth with the potential to invade or spread to other 11 parts of the body. 12 Sec. 3. IMPLEMENTATION OF ACT. Section 25B.2, subsection 13 3, shall not apply to this Act. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanations substance by the members of the general assembly. 17 This bill concerns benefits relating to members of the 18 public safety peace officers retirement, accident, and 19 disability system (PORS), and the municipal fire and police 20 retirement system (411 system). 21 The bill expands the definition of cancer by striking 22 references to specific cancers and inserting a more generalized 23 description. By expanding the definition of cancer to 24 include more cancer diagnoses, the bill likewise expands the 25 availability of accidental disability and death benefits to 26 members of PORS or the 411 system who have a cancer diagnosis. 27 By operation of law, the bill also expands the definition 28 of cancer as used in Code section 97B.50A for purposes of 29 in-service disability retirement allowance for special service 30 members under the Iowa public employees retirement system. 31 The bill may include a state mandate as defined in Code 32 section 25B.3. The bill makes inapplicable Code section 25B.2, 33 subsection 3, which would relieve a political subdivision from 34 complying with a state mandate if funding for the cost of 35 -1- LSB 1703YH (3) 91 sc/ns 1/ 2 H.F. 267 the state mandate is not provided or specified.
