Section 728.2, Code 2025, is amended to read as 1 follows: 2 728.2 Dissemination and exhibition of obscene material to 3 minors. 4 Any person eighteen years of age or older , other than the 5 parent or guardian of the minor, who knowingly disseminates or 6 exhibits obscene material to a minor, including the exhibition 7 of obscene material so that it can be observed by a minor on 8 or off the premises where it is displayed, is guilty of a 9 public offense and shall upon conviction be guilty of a serious 10 misdemeanor. as follows: 11 1. For a first offense, a serious misdemeanor. 12 2. For a second offense, an aggravated misdemeanor with a 13 mandatory minimum term of confinement of one year. No portion 14 of the mandatory minimum term of confinement imposed by this 15 subsection shall be deferred or suspended. 16 3. For a third or subsequent offense, a class D felony 17 with a mandatory minimum term of confinement of three years. 18 No portion of the mandatory minimum term of confinement imposed 19 by this subsection shall be deferred or suspended. 20 Sec. 2. NEW SECTION . 728.2A Minors distributing obscene 21 material to minors. 22 Any person under the age of eighteen who knowingly 23 distributes obscene material to another minor is guilty of a 24 public offense and shall upon conviction be guilty of a serious 25 misdemeanor. 26 -1- HF 306 (3) 91 as/js/md 1/ 1
