Section 708.3A, subsection 5, paragraph d, Code 1 2025, is amended to read as follows: 2 d. Health care provider means an emergency medical care 3 provider as defined in chapter 147A or a person licensed 4 or registered under chapter 148 , 148C , 148D , or 152 who is 5 providing or who is attempting to provide emergency medical 6 services, as defined in section 147A.1 , or anyone who is 7 providing or who is attempting to provide health services 8 as defined in section 10A.711 in working, volunteering, or 9 participating in an educational course of instruction at a 10 hospital or rural emergency hospital as defined in chapter 11 135B , or at a nursing facility as defined in chapter 135C . A 12 person who commits an assault under this section against a 13 health care provider in a hospital, or at the scene or during 14 out-of-hospital patient transportation in an ambulance, is 15 presumed to know that the person against whom the assault is 16 committed is a health care provider. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanations substance by the members of the general assembly. 20 This bill relates to assaults on persons engaged in certain 21 occupations including a health care provider. 22 The bill amends the definition of health care provider to 23 include a person who is working, volunteering, or participating 24 in an educational course of instruction at a hospital, rural 25 emergency hospital, or at a nursing facility. 26 An assault on a health care provider can result in penalties 27 including a serious misdemeanor, an aggravated misdemeanor, or 28 a class D felony. A serious misdemeanor is punishable by 29 confinement for no more than one year and a fine of at least 30 $430 but not more than $2,560. An aggravated misdemeanor is 31 punishable by confinement for no more than two years and a fine 32 of at least $855 but not more than $8,540. A class D felony 33 is punishable by confinement for no more than five years and a 34 fine of at least $1,025 but not more than $10,245. 35 -1- LSB 1156HV (3) 91 as/js 1/ 1
