House File 509 - Introduced HOUSE FILE 509 BY COMMITTEE ON HEALTH AND HUMAN SERVICES (SUCCESSOR TO HSB 122) A BILL FOR An Act relating to Hawki coverage for the treatment of autism 1 spectrum disorder applied behavior analysis services, and 2 the autism support program. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 4 TLSB 1843HV (3) 91 lh/ko H.F. 509 Section 1. Section 225D.2, Code 2025, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. The department shall not approve a new 3 application for the autism support program on or after July 4 1, 2025. The department shall continue to provide treatment 5 and make payments pursuant to the program for an eligible 6 individual whose application is approved on or before June 30, 7 2025, if the individual remains eligible for the program. 8 Sec. 2. NEW SECTION . 225D.3 Future repeal. 9 This chapter is repealed July 1, 2027. 10 Sec. 3. Section 514I.5, subsection 4, paragraph c, Code 11 2025, is amended by adding the following new subparagraph: 12 NEW SUBPARAGRAPH . (18) Applied behavior analysis services 13 for the treatment of autism spectrum disorder. 14 Sec. 4. TRANSFER OF MONEYS. Upon repeal of chapter 225D on 15 July 1, 2027, any unencumbered and unobligated moneys remaining 16 in the autism support fund created in section 225D.2, are 17 transferred to the Hawki trust fund created in section 514I.11. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanations substance by the members of the general assembly. 21 This bill relates to the healthy and well kids in Iowa 22 program (Hawki) coverage for applied behavior analysis services 23 for the treatment of autism spectrum disorder, and the autism 24 support fund. 25 The bill prohibits the department of health and human 26 services (HHS) from approving new applications for the autism 27 support program (program) on or after July 1, 2025. HHS shall 28 continue to provide treatment and make payments pursuant to the 29 program for an individual whose application is approved on or 30 before June 30, 2025, if the individual remains eligible for 31 the program. 32 The bill repeals the program July 1, 2027. 33 The bill requires the medical assistance advisory council 34 to adopt rules to include applied behavior analysis services 35 -1- LSB 1843HV (3) 91 lh/ko 1/ 2 H.F. 509 for the treatment of autism as benefits covered in a qualified 1 child health plan included in a benchmark or benchmark 2 equivalent plan and which comply with Tit. XXI of the federal 3 Social Security Act. 4 The bill requires, upon the repeal of Code chapter 225D on 5 July 1, 2027, any unencumbered and unobligated moneys remaining 6 in the autism support fund be transferred to the Hawki trust 7 fund. 8 -2- LSB 1843HV (3) 91 lh/ko 2/ 2
