  H.F. 969   Section 1. Section 97A.1, subsection 6, Code 2025, is 1   amended by striking the subsection and inserting in lieu 2   thereof the following: 3   6. Cancer means a group of diseases involving abnormal 4   cell growth with the potential to invade or spread to other 5   parts of the body. 6   Sec. 2. Section 97B.11, subsection 3, paragraphs b and c, 7   Code 2025, are amended to read as follows: 8   b. For members in special service in a protection occupation 9   as described in section 97B.49B : 10   (1) Applicable employee percentage means the percentage 11   rate equal to forty percent of the required contribution rate 12   for members described in section 97B.49B . For the fiscal year   13   beginning July 1, 2025, and for each fiscal year thereafter,   14   the system shall increase the applicable employee percentage 15   calculated under this subparagraph for that fiscal year by one 16   hundred twenty-five thousandths of one percent. 17   (2) Applicable employer percentage means the percentage 18   rate equal to sixty percent of the required contribution rate 19   for members described in section 97B.49B . For the fiscal year   20   beginning July 1, 2025, and for each fiscal year thereafter,   21   the system shall decrease the applicable employer percentage 22   calculated under this subparagraph for that fiscal year by one   23   hundred twenty-five thousandths of one percent. 24   c. For members in special service as a county sheriff or 25   deputy sheriff as described in section 97B.49C : 26   (1) Applicable employee percentage means the percentage 27   rate equal to fifty percent of the required contribution rate 28   for members described in section 97B.49C . For the fiscal year 29   beginning July 1, 2025, and for each fiscal year thereafter,   30   the system shall increase the applicable employee percentage 31   calculated under this subparagraph for that fiscal year by one   32   hundred twenty-five thousandths of one percent. 33   (2) Applicable employer percentage means the percentage 34   rate equal to fifty percent of the required contribution rate 35   -1-   HF 969 (3) 91   sc/ns/md 1/ 3

For the fiscal year 1   beginning July 1, 2025, and for each fiscal year thereafter,   2   the system shall decrease the applicable employer percentage 3   calculated under this subparagraph for that fiscal year by one 4   hundred twenty-five thousandths of one percent.   5   Sec. 3. Section 411.1, subsection 6, Code 2025, is amended 6   by striking the subsection and inserting in lieu thereof the 7   following: 8   6. Cancer means a group of diseases involving abnormal 9   cell growth with the potential to invade or spread to other 10   parts of the body. 11   Sec. 4. Section 411.8, subsection 1, paragraph f, 12   subparagraph (8), Code 2025, is amended to read as follows: 13   (8) Beginning July 1, 1996, and each fiscal year thereafter, 14   an amount equal to the members contribution rate times each 15   members compensation shall be paid to the fund from the 16   earnable compensation of the member. For the purposes of this 17   subparagraph, the members contribution rate shall be nine and 18   thirty-five hundredths percent until June 30, 2009, nine and 19   four-tenths percent until June 30, 2024, and, beginning July   20   1, 2024,   nine and fifty-five hundredths percent until June 21   30, 2025, and, beginning July 1, 2025, nine and six hundred 22   seventy-five thousandths percent   . However, the system shall 23   increase the members contribution rate as necessary to cover 24   any increase in cost to the system resulting from statutory 25   changes which are enacted by any session of the general 26   assembly meeting after January 1, 1991, if the increase cannot 27   be absorbed within the contribution rates otherwise established   28   pursuant to this paragraph, but subject to a maximum employee 29   contribution rate of eleven and three-tenths percent or,   30   beginning July 1, until June 30, 2009, eleven and thirty-five 31   hundredths percent until June 30, 2025, and, beginning July   32   1, 2025, eleven and four hundred seventy-five thousandths 33   percent   . The contribution rate increases specified in 1994 34   Iowa Acts, ch. 1183 , pursuant to this chapter and chapter 35   -2-   HF 969 (3) 91   sc/ns/md 2/ 3                  

  H.F. 969   97A shall be the only member contribution rate increases for 1   these systems resulting from the statutory changes enacted in 2   1994 Iowa Acts, ch. 1183 , and shall apply only to the fiscal 3   periods specified in 1994 Iowa Acts, ch. 1183 . After the 4   employee contribution reaches eleven and three-tenths percent 5   or eleven and thirty-five hundredths percent, as applicable,   6   the applicable maximum employee contribution rate, sixty 7   percent of the additional cost of such statutory changes shall 8   be paid by employers under paragraph c and forty percent 9   of the additional cost shall be paid by employees under this 10   paragraph. 11   Sec. 5. IMPLEMENTATION OF ACT. Section 25B.2, subsection 12   3, shall not apply to this Act. 13   Sec. 6. EMERGENCY RULES. The Iowa public employees 14   retirement system may adopt emergency rules under section 15   17A.4, subsection 3, and section 17A.5, subsection 2, paragraph 16   b, to implement section 97B.11, subsection 3, paragraphs 17   b and c, as amended by this Act, and the rules shall be 18   effective immediately upon filing unless a later date is 19   specified in the rules. Any rules adopted in accordance with 20   this section shall also be published as a notice of intended 21   action as provided in section 17A.4. 22   Sec. 7. EFFECTIVE DATE.
