Senate Study Bill 1132 - Introduced SENATE JOINT RESOLUTION _____ BY (PROPOSED COMMITTEE ON NATURAL RESOURCES AND ENVIRONMENT RESOLUTION BY CHAIRPERSON SWEENEY) SENA TE JOINT RESOLUTION A Joint Resolution proposing an amendment to the Constitution 1 of the State of Iowa providing that the people of the state 2 have a right to hunt, fish, trap, and harvest wildlife. 3 BE IT RESOLVED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 4 TLSB 1381XC (2) 91 sb/js S.J.R. _____ Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 Article I of the Constitution of the State of Iowa is amended 3 by adding the following new section: 4 Sec. 24A. Right to hunt, fish, trap, and harvest wildlife. 5 1. The people of this state have the right to hunt, fish, 6 trap, and harvest wildlife, including by the use of traditional 7 methods, subject to laws enacted by the general assembly 8 that preserve the future of hunting, fishing, trapping, and 9 harvesting wildlife. 10 2. Public hunting, fishing, trapping, and harvesting of 11 wildlife shall be a preferred means of managing and controlling 12 wildlife. 13 3. This section shall not be construed to modify any 14 provision of law relating to eminent domain, trespass, property 15 rights, or water resources. 16 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 17 amendment to the Constitution of the State of Iowa is referred 18 to the general assembly to be chosen at the next general 19 election for members of the general assembly, and shall be 20 published as provided by law for three months previous to the 21 date of that election. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanations substance by the members of the general assembly. 25 This joint resolution proposes an amendment to the 26 Constitution of the State of Iowa providing that the people 27 of this state have the right to hunt, fish, trap, and harvest 28 wildlife, including by the use of traditional methods, subject 29 to laws enacted by the general assembly that preserve the 30 future of hunting, fishing, trapping, and harvesting wildlife. 31 The proposed amendment further states that hunting, fishing, 32 trapping, and harvesting wildlife shall be a preferred means 33 of managing and controlling wildlife and that the proposed 34 amendment shall not be construed to modify any provision of law 35 -1- LSB 1381XC (2) 91 sb/js 1/ 2 S.J.R. _____ relating to eminent domain, trespass, property rights, or water 1 resources. 2 The resolution, if adopted, would be published and then 3 referred to the next general assembly (92nd) for adoption, 4 before being submitted to the electorate for ratification. 5 -2- LSB 1381XC (2) 91 sb/js 2/ 2
