Lawrence "Larry" Walsh, Jr. SYNOPSIS AS INTRODUCED:   55 ILCS 5/3-10020 from Ch. 34, par. 3-10020   Amends the Counties Code. Repeals a provision which specifies that the office of county treasurer shall become vacant if, in certain circumstances, the county treasurer neglects or refuses to render an account or make settlement at any time when required by law, refuses to answer any question regarding the operation of the county treasurer's office propounded by the county board, or refuses to provide the county board with any requested information concerning the accounts maintained by the county treasurer's office. Provides that the office of county treasurer shall become vacant if the county treasurer dies or resigns or the office otherwise becomes vacant. 1  AN ACT concerning local government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Counties Code is amended by changing
5  Section 3-10020 as follows:
6  (55 ILCS 5/3-10020) (from Ch. 34, par. 3-10020)
7  Sec. 3-10020. Vacancy. Removal for cause; other vacancy.
8  If the county treasurer dies or resigns or the office of county
9  treasurer become vacant for any other reason, If any county
10  treasurer shall neglect or refuse to render an account, or
11  make settlement at any time when required by law, or refuse to
12  answer any question regarding the operation of the county
13  treasurer's office propounded to him by the county board, or
14  refuse to provide the county board with any requested
15  information concerning the accounts maintained by the county
16  treasurer's office, provided the requests are for information
17  that the county treasurer is required by law to maintain and in
18  a format already maintained by the county treasurer, or is a
19  defaulter, and in arrears with the county, or is guilty of any
20  other misconduct in his office, the county board may remove
21  him from office, and the presiding officer of the county
22  board, with the advice and consent of the county board, may
23  appoint some suitable person to perform the duties of

1  treasurer until his successor is elected, or appointed and
2  qualified; or if by reason of the death or resignation of the
3  county treasurer, or other cause, the said office shall become
4  vacant, then the vacancy shall be filled as provided in the The
5  Election Code by appointment of some suitable person to
6  perform the duties of treasurer, until a county treasurer is
7  elected or appointed and qualified. Provided, that in case any
8  county treasurer is called into the active military service of
9  the United States, the appointee shall perform and discharge
10  all the duties of the county treasurer in such county during
11  the time such county treasurer is in the active military
12  service of the United States, and such county treasurer so
13  appointed shall possess all the powers and discharge all the
14  duties of a regularly elected county treasurer under the laws
15  of this State, and shall be paid the same compensation as
16  provided by law for the county treasurer of the county,
17  apportioned as to the time of service, and such appointment
18  and all authority thereunder shall cease upon the discharge of
19  said county treasurer from such active military service of the
20  United States; and provided further, that the office of county
21  treasurer shall not be deemed to be vacant during the time the
22  said county treasurer is in the active military service of the
23  United States. The person so appointed, shall give bond and
24  security, as required by law of the county treasurer.
