                    103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB2459 Introduced , by Rep. Martin J. Moylan SYNOPSIS AS INTRODUCED:  415 ILCS 5/9.19 new  Amends the Environmental Protection Act. Requires the Environmental Protection Agency to establish a fleet electrification voucher program to promote the use of electric school buses, electric Class 7 trucks, and electric Class 8 trucks by fleet owners by offering a voucher of $200,000 per electric school bus, electric Class 7 truck, or electric Class 8 truck purchased or leased for a fleet by the fleet's owner or operator. Provides that an applicant shall submit a proof of purchase, lease, or other binding contract regarding the electric school bus, electric Class 7 truck, or electric Class 8 truck in order to be awarded the voucher. Provides that, upon approval of the initial application, an applicant must scrap a diesel school bus, diesel Class 7 truck, or diesel Class 8 truck from the applicant's existing fleet. 1  AN ACT concerning safety.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Environmental Protection Act is amended by
5  adding Section 9.19 as follows:
6  (415 ILCS 5/9.19 new)
7  Sec. 9.19. Fleet electrification voucher program.
8  (a) The Agency shall establish a fleet electrification
9  voucher program to promote the use of electric school buses,
10  electric Class 7 trucks, and electric Class 8 trucks by fleet
11  owners and operators. The program shall offer a voucher of
12  $200,000 per electric school bus, electric Class 7 truck, or
13  electric Class 8 truck purchased or leased for a fleet by the
14  fleet's owner or operator.
15  (b) Vouchers offered under this Section shall be made
16  available for electric school buses, electric Class 7 trucks,
17  and electric Class 8 trucks that are registered in Illinois or
18  recognized under the International Registration Plan and whose
19  applicant fleet owners or operators have a primary residence
20  in Illinois. Vouchers must be made available for direct
21  purchases, purchases through third-party bulk orders, and
22  leasing of electric school buses, electric Class 7 trucks, and
23  electric Class 8 trucks.

1  (c) After an applicant receives notification that the
2  applicant's voucher request has been granted preliminary
3  approval by the Agency, the applicant shall submit a proof of
4  purchase, lease, or other binding contract regarding the
5  electric school bus, electric Class 7 truck, or electric Class
6  8 truck in order to be awarded the voucher. The preliminary
7  approval of the voucher request may be renewed at 3-month
8  intervals for up to 18 months, pending receipt of the
9  applicant's proof of purchase, lease, or other binding
10  contract regarding the purchase or leasing of the electric
11  school bus, electric Class 7 truck, or electric Class 8 truck.
12  (d) A fleet owner or operator who receives a voucher under
13  this Section must retain title or right of use of the electric
14  school bus, electric Class 7 truck, or electric Class 8 truck
15  incentivized under the program for a minimum of 36 consecutive
16  months after the purchase date or lease date of the electric
17  school bus, electric Class 7 truck, or electric Class 8 truck.
18  Resale or sublease of the electric school bus, electric Class
19  7 truck, or electric Class 8 truck for financial gain within 36
20  months after the purchase date or lease date is prohibited.
21  (e) If the electric school bus, electric Class 7 truck, or
22  electric Class 8 truck of an applicant is leased, a lease term
23  of at least 36 months is required for the electric school bus,
24  electric Class 7 truck, or electric Class 8 truck to be
25  eligible for the program.

1  Class 7 truck, or electric Class 8 truck in the applicant's
2  fleet is required within 24 months after receipt of voucher
3  funds under the program. Total completion of the project for
4  which the electric school bus, electric Class 7 truck, or
5  electric Class 8 truck is purchased or leased must occur
6  within 36 months after receipt of voucher funds under the
7  program.
8  (g) Upon approval of an initial application for a voucher
9  under this Section, the applicant must scrap a diesel school
10  bus, diesel Class 7 truck, or diesel Class 8 truck from the
11  applicant's existing fleet. There is no vehicle age
12  requirement for scrapping a diesel school bus, diesel Class 7
13  truck, or diesel Class 8 truck under the program.
14  (h) An applicant who is awarded a voucher under this
15  Section must agree to participate in annual surveys on metrics
16  as determined by the Agency, such as average daily mileage,
17  kilowatts consumed, and emissions reduction data.
18  (i) In this Section:
19  "Class 7 truck" means a truck categorized by the Federal
20  Highway Administration, using gross vehicle weight ratings, as
21  a Class 7 vehicle.
22  "Class 8 truck" means a truck categorized by the Federal
23  Highway Administration, using gross vehicle weight ratings, as
24  a Class 8 vehicle.
