                    103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB2852 Introduced , by Rep. Dave Severin SYNOPSIS AS INTRODUCED:   715 ILCS 5/2 from Ch. 100, par. 2 715 ILCS 5/2.1  Amends the Notice by Publication Act. When a unit of local government or school district is required by law to give notice by publication in a newspaper, provides that: if there is no secular newspaper having a general circulation within the unit of local government or school district, the local government or school district may publish the notice on an official government website of a local government or school district, or if there is no official government website of a local government or school district, the local government or school district shall post copies of the printed notice in 5 of the most public places within that local government or school district; and if a local government or school district publishes notices on an official website or posts copies of the printed notice, whom would otherwise would be required by law, order of court, or contract to publish the notice within a newspaper, the local government or school district shall cause such notices to be placed on a statewide website established and maintained as a joint venture of a majority of State newspapers as a repository for such notices. 1  AN ACT concerning notices.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Notice By Publication Act is amended by
5  changing Sections 2 and 2.1 as follows:
6  (715 ILCS 5/2) (from Ch. 100, par. 2)
7  Sec. 2. Whenever an officer of a court, unit of local
8  government, or school district is required by law to give
9  notice by publication in a newspaper which is published in a
10  particular unit of local government or school district, he
11  shall, if there is no newspaper which is published in the unit
12  of local government or school district, give notice by
13  publication in a secular newspaper, as defined in this Act,
14  having general circulation within the unit of local government
15  or school district. If there is no secular newspaper having a
16  general circulation within the unit of local government or
17  school district, the local government or school district may
18  publish the notice on an official government website of a
19  local government or school district, or if there is no
20  official government website of a local government or school
21  district, the local government or school district shall post
22  copies of the printed notice in 5 of the most public places
23  within that local government or school district.

3  Sec. 2.1. Statewide website. Whenever notice by
4  publication in a newspaper is required by law, order of court,
5  or contract, the newspaper publishing the notice shall, at no
6  additional cost to government, cause the notice to be placed
7  on the statewide website established and maintained as a joint
8  venture of the majority of Illinois newspapers as a repository
9  for such notices. If a local government or school district
10  publishes notices on an official website or posts copies of
11  the printed notice in accordance with Section 2, whom would
12  otherwise would be required by law, order of court, or
13  contract to publish the notice within a newspaper, the local
14  government or school district shall cause such notices to be
15  placed on a statewide website established and maintained as a
16  joint venture of a majority of State newspapers as a
17  repository for such notices.

19  Section 99. Effective date. This Act takes effect upon
