Harper SYNOPSIS AS INTRODUCED:   510 ILCS 50/9 from Ch. 8, par. 176   Amends the Illinois Diseased Animals Act. Provides that if the condition so warrants, the Director of Agriculture may declare a temporary prohibition on the sale, movement, or exhibition of certain types of animals in order to prevent or reduce the spread of any contamination or disease in the State. Provides that the declaration shall be for a period not to exceed 30 days, but the declaration may be extended in increments not to exceed 30 days if the condition so warrants. 1  AN ACT concerning animals.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois Diseased Animals Act is amended by
5  changing Section 9 as follows:
6  (510 ILCS 50/9) (from Ch. 8, par. 176)
7  Sec. 9. The Department may promulgate and adopt reasonable
8  rules and regulations to prevent the spread of any
9  contamination or contagious or infectious disease within this
10  State. If the condition so warrants, the Director may request
11  the Governor to issue a proclamation quarantining an affected
12  municipality or geographical district whereby all animals of
13  the kind diseased or contaminated would not be permitted to be
14  moved from one premises to another within the municipality or
15  geographical district, or over any public highway, or any
16  unfenced lot or piece of ground, or from being brought into, or
17  taken from the infected or contaminated municipality or
18  geographical district, except by a special permit, signed by
19  the Director. Any such proclamation shall, from the time of
20  its publication, bind all persons. Within one week after the
21  publication of any such proclamation, every person who owns,
22  or who is in charge of animals of the kind diseased or
23  contaminated within the municipality or geographical district,

1  shall report to the Department the number and description of
2  such animals, their location, and the name and address of the
3  owner or person in charge, and during the continuance of the
4  quarantine to report to the Department all cases of sickness,
5  deaths or births among such animals.
6  If the condition so warrants, the Director may declare a
7  temporary prohibition on the sale, movement, or exhibition of
8  certain types of animals in order to prevent or reduce the
9  spread of any contamination or disease in this State. The
10  declaration shall be for a period not to exceed 30 days, but
11  the declaration may be extended in increments not to exceed 30
12  days if the condition so warrants.
