Willie Preston SYNOPSIS AS INTRODUCED: 30 ILCS 500/55-30 new Amends the Illinois Procurement Code. Provides that, if a public institution of higher education or a State agency uses a value-added reseller for the purchase of any information technology hardware under the Code, then that public institution of higher education or State agency may require the value-added reseller to include in its bid an attestation from the manufacturer of the goods stating that the manufacturer offers the goods for sale to all value-added resellers at substantially the same terms that apply to the bidder's purchase of the goods. Requires the Department of Innovation and Technology and the University of Illinois each to include those requirements when making at least one procurement of information technology hardware during State fiscal year 2025. 1  AN ACT concerning State government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois Procurement Code is amended by
5  adding Section 55-30 as follows:
6  (30 ILCS 500/55-30 new)
7  Sec. 55-30. Value-added resellers.
8  (a) If a public institution of higher education or a State
9  agency uses a value-added reseller for the purchase of any
10  information technology hardware under this Code, then that
11  public institution of higher education or State agency may
12  require the value-added reseller to include in its bid an
13  attestation from the manufacturer of the goods stating that
14  the manufacturer offers the goods for sale to all value-added
15  resellers at substantially the same terms that apply to the
16  bidder's purchase of the goods from the manufacturer,
17  including price, discounts, commissions, rebates, and other
18  incentives that impact the consideration paid for the goods.
19  If the public institution of higher education or State agency
20  imposes such a requirement, then the specifications for the
21  bid must clearly include this requirement.
22  (b) Notwithstanding any other provision of law, the

1  Illinois must each include the requirements set forth in
2  subsection (a) when making at least one procurement of
3  information technology hardware during State fiscal year 2025.
4  (c) As used in this Section:
5  "Information technology hardware" means laptops, desktops,
6  tablets, monitors, docking stations, telephones, headsets,
7  cable cords, computers, servers, and wires.
8  "Public institution of higher education" has the meaning
9  given to that term in Section 1-13.
10  "Value-added reseller" means a company that resells
11  information technology hardware and provides value, such as
12  installation services, software, or service contracts, in
13  addition to the original order fulfillment.
