1  AN ACT concerning transportation.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois Identification Card Act is amended
5  by changing Sections 4 and 5 as follows:

8  Sec. 4. Identification card.
9  (a) The Secretary of State shall issue a standard Illinois
10  Identification Card to any natural person who is a resident of
11  the State of Illinois who applies for such card, or renewal
12  thereof. No identification card shall be issued to any person
13  who holds a valid foreign state identification card, license,
14  or permit unless the person first surrenders to the Secretary
15  of State the valid foreign state identification card, license,
16  or permit. The card shall be prepared and supplied by the
17  Secretary of State and shall include a photograph and
18  signature or mark of the applicant. However, the Secretary of
19  State may provide by rule for the issuance of Illinois
20  Identification Cards without photographs if the applicant has
21  a bona fide religious objection to being photographed or to
22  the display of his or her photograph. The Illinois
23  Identification Card may be used for identification purposes in

1  any lawful situation only by the person to whom it was issued.
2  As used in this Act, "photograph" means any color photograph
3  or digitally produced and captured image of an applicant for
4  an identification card. As used in this Act, "signature" means
5  the name of a person as written by that person and captured in
6  a manner acceptable to the Secretary of State.
7  (a-5) If an applicant for an identification card has a
8  current driver's license or instruction permit issued by the
9  Secretary of State, the Secretary may require the applicant to
10  utilize the same residence address and name on the
11  identification card, driver's license, and instruction permit
12  records maintained by the Secretary. The Secretary may
13  promulgate rules to implement this provision.
14  (a-10) If the applicant is a judicial officer as defined
15  in Section 1-10 of the Judicial Privacy Act or a peace officer,
16  the applicant may elect to have his or her office or work
17  address listed on the card instead of the applicant's
18  residence or mailing address. The Secretary may promulgate
19  rules to implement this provision. For the purposes of this
20  subsection (a-10), "peace officer" means any person who by
21  virtue of his or her office or public employment is vested by
22  law with a duty to maintain public order or to make arrests for
23  a violation of any penal statute of this State, whether that
24  duty extends to all violations or is limited to specific
25  violations.
26  (a-15) The Secretary of State may provide for an expedited

1  process for the issuance of an Illinois Identification Card.
2  The Secretary shall charge an additional fee for the expedited
3  issuance of an Illinois Identification Card, to be set by
4  rule, not to exceed $75. All fees collected by the Secretary
5  for expedited Illinois Identification Card service shall be
6  deposited into the Secretary of State Special Services Fund.
7  The Secretary may adopt rules regarding the eligibility,
8  process, and fee for an expedited Illinois Identification
9  Card. If the Secretary of State determines that the volume of
10  expedited identification card requests received on a given day
11  exceeds the ability of the Secretary to process those requests
12  in an expedited manner, the Secretary may decline to provide
13  expedited services, and the additional fee for the expedited
14  service shall be refunded to the applicant.
15  (a-20) The Secretary of State shall issue a standard
16  Illinois Identification Card to a person committed to the
17  Department of Corrections or Department of Juvenile Justice
18  upon receipt of the person's birth certificate, social
19  security card, photograph, proof of residency upon discharge,
20  and an identification card application transferred via a
21  secure method as agreed upon by the Secretary and the
22  Department of Corrections or Department of Juvenile Justice.
23  Illinois residency shall be established by submission of a
24  Secretary of State prescribed Identification Card verification
25  form completed by the respective Department.
26  (a-25) The Secretary of State shall issue a limited-term

1  Illinois Identification Card valid for 90 days to a committed
2  person upon release on parole, mandatory supervised release,
3  aftercare release, final discharge, or pardon from the
4  Department of Corrections or Department of Juvenile Justice,
5  if the released person is unable to present a certified copy of
6  his or her birth certificate and social security card or other
7  documents authorized by the Secretary, but does present a
8  Secretary of State prescribed Identification Card verification
9  form completed by the Department of Corrections or Department
10  of Juvenile Justice, verifying the released person's date of
11  birth, social security number, and his or her Illinois
12  residence address. The verification form must have been
13  completed no more than 30 days prior to the date of application
14  for the Illinois Identification Card.
15  Prior to the expiration of the 90-day period of the
16  limited-term Illinois Identification Card, if the released
17  person submits to the Secretary of State a certified copy of
18  his or her birth certificate and his or her social security
19  card or other documents authorized by the Secretary, a
20  standard Illinois Identification Card shall be issued. A
21  limited-term Illinois Identification Card may not be renewed.
22  (a-30) The Secretary of State shall issue a standard
23  Illinois Identification Card to a person upon conditional
24  release or absolute discharge from the custody of the
25  Department of Human Services, if the person presents a
26  certified copy of his or her birth certificate, social

2  and a document proving his or her Illinois residence address.
3  The Secretary of State shall issue a standard Illinois
4  Identification Card to a person prior to his or her
5  conditional release or absolute discharge if personnel from
6  the Department of Human Services bring the person to a
7  Secretary of State location with the required documents.
8  Documents proving residence address may include any official
9  document of the Department of Human Services showing the
10  person's address after release and a Secretary of State
11  prescribed verification form, which may be executed by
12  personnel of the Department of Human Services.
13  (a-35) The Secretary of State shall issue a limited-term
14  Illinois Identification Card valid for 90 days to a person
15  upon conditional release or absolute discharge from the
16  custody of the Department of Human Services, if the person is
17  unable to present a certified copy of his or her birth
18  certificate and social security card or other documents
19  authorized by the Secretary, but does present a Secretary of
20  State prescribed verification form completed by the Department
21  of Human Services, verifying the person's date of birth and
22  social security number, and a document proving his or her
23  Illinois residence address. The verification form must have
24  been completed no more than 30 days prior to the date of
25  application for the Illinois Identification Card. The

2  his or her conditional release or absolute discharge if
3  personnel from the Department of Human Services bring the
4  person to a Secretary of State location with the required
5  documents. Documents proving residence address shall include
6  any official document of the Department of Human Services
7  showing the person's address after release and a Secretary of
8  State prescribed verification form, which may be executed by
9  personnel of the Department of Human Services.
10  (b) The Secretary of State shall issue a special Illinois
11  Identification Card, which shall be known as an Illinois
12  Person with a Disability Identification Card, to any natural
13  person who is a resident of the State of Illinois, who is a
14  person with a disability as defined in Section 4A of this Act,
15  who applies for such card, or renewal thereof. No Illinois
16  Person with a Disability Identification Card shall be issued
17  to any person who holds a valid foreign state identification
18  card, license, or permit unless the person first surrenders to
19  the Secretary of State the valid foreign state identification
20  card, license, or permit. The Secretary of State shall charge
21  no fee to issue such card. The card shall be prepared and
22  supplied by the Secretary of State, and shall include a
23  photograph and signature or mark of the applicant, a
24  designation indicating that the card is an Illinois Person
25  with a Disability Identification Card, and shall include a
26  comprehensible designation of the type and classification of

1  the applicant's disability as set out in Section 4A of this
2  Act. However, the Secretary of State may provide by rule for
3  the issuance of Illinois Person with a Disability
4  Identification Cards without photographs if the applicant has
5  a bona fide religious objection to being photographed or to
6  the display of his or her photograph. If the applicant so
7  requests, the card shall include a description of the
8  applicant's disability and any information about the
9  applicant's disability or medical history which the Secretary
10  determines would be helpful to the applicant in securing
11  emergency medical care. If a mark is used in lieu of a
12  signature, such mark shall be affixed to the card in the
13  presence of two witnesses who attest to the authenticity of
14  the mark. The Illinois Person with a Disability Identification
15  Card may be used for identification purposes in any lawful
16  situation by the person to whom it was issued.
17  The Illinois Person with a Disability Identification Card
18  may be used as adequate documentation of disability in lieu of
19  a physician's determination of disability, a determination of
20  disability from a physician assistant, a determination of
21  disability from an advanced practice registered nurse, or any
22  other documentation of disability whenever any State law
23  requires that a person with a disability provide such
24  documentation of disability, however an Illinois Person with a
25  Disability Identification Card shall not qualify the
26  cardholder to participate in any program or to receive any

1  benefit which is not available to all persons with like
2  disabilities. Notwithstanding any other provisions of law, an
3  Illinois Person with a Disability Identification Card, or
4  evidence that the Secretary of State has issued an Illinois
5  Person with a Disability Identification Card, shall not be
6  used by any person other than the person named on such card to
7  prove that the person named on such card is a person with a
8  disability or for any other purpose unless the card is used for
9  the benefit of the person named on such card, and the person
10  named on such card consents to such use at the time the card is
11  so used.
12  An optometrist's determination of a visual disability
13  under Section 4A of this Act is acceptable as documentation
14  for the purpose of issuing an Illinois Person with a
15  Disability Identification Card.
16  When medical information is contained on an Illinois
17  Person with a Disability Identification Card, the Office of
18  the Secretary of State shall not be liable for any actions
19  taken based upon that medical information.
20  (c) The Secretary of State shall provide that each
21  original or renewal Illinois Identification Card or Illinois
22  Person with a Disability Identification Card issued to a
23  person under the age of 21 shall be of a distinct nature from
24  those Illinois Identification Cards or Illinois Person with a
25  Disability Identification Cards issued to individuals 21 years
26  of age or older. The color designated for Illinois

1  Identification Cards or Illinois Person with a Disability
2  Identification Cards for persons under the age of 21 shall be
3  at the discretion of the Secretary of State.
4  (c-1) Each original or renewal Illinois Identification
5  Card or Illinois Person with a Disability Identification Card
6  issued to a person under the age of 21 shall display the date
7  upon which the person becomes 18 years of age and the date upon
8  which the person becomes 21 years of age.
9  (c-3) The General Assembly recognizes the need to identify
10  military veterans living in this State for the purpose of
11  ensuring that they receive all of the services and benefits to
12  which they are legally entitled, including healthcare,
13  education assistance, and job placement. To assist the State
14  in identifying these veterans and delivering these vital
15  services and benefits, the Secretary of State is authorized to
16  issue Illinois Identification Cards and Illinois Person with a
17  Disability Identification Cards with the word "veteran"
18  appearing on the face of the cards. This authorization is
19  predicated on the unique status of veterans. The Secretary may
20  not issue any other identification card which identifies an
21  occupation, status, affiliation, hobby, or other unique
22  characteristics of the identification card holder which is
23  unrelated to the purpose of the identification card.
24  (c-5) Beginning on or before July 1, 2015, the Secretary
25  of State shall designate a space on each original or renewal
26  identification card where, at the request of the applicant,

1  the word "veteran" shall be placed. The veteran designation
2  shall be available to a person identified as a veteran under
3  subsection (b) of Section 5 of this Act who was discharged or
4  separated under honorable conditions.
5  (d) The Secretary of State may issue a Senior Citizen
6  discount card, to any natural person who is a resident of the
7  State of Illinois who is 60 years of age or older and who
8  applies for such a card or renewal thereof. The Secretary of
9  State shall charge no fee to issue such card. The card shall be
10  issued in every county and applications shall be made
11  available at, but not limited to, nutrition sites, senior
12  citizen centers and Area Agencies on Aging. The applicant,
13  upon receipt of such card and prior to its use for any purpose,
14  shall have affixed thereon in the space provided therefor his
15  signature or mark.
16  (e) The Secretary of State, in his or her discretion, may
17  designate on each Illinois Identification Card or Illinois
18  Person with a Disability Identification Card a space where the
19  card holder may place a sticker or decal, issued by the
20  Secretary of State, of uniform size as the Secretary may
21  specify, that shall indicate in appropriate language that the
22  card holder has renewed his or her Illinois Identification
23  Card or Illinois Person with a Disability Identification Card.
24  (f) Upon providing required documentation, at the request
25  of the applicant, the identification card may reflect Gold
26  Star Family designation. The Secretary shall designate a space

3  eligible for Gold Star license plates under subsection (f) of
4  Section 6-106 of the Illinois Vehicle Code.

2  designation indicating that the card is an Illinois Person
3  with a Disability Identification Card, and shall include a
4  comprehensible designation of the type and classification of
5  the applicant's disability as set out in Section 4A of this
6  Act. However, the Secretary of State may provide by rule for
7  the issuance of Illinois Person with a Disability
8  Identification Cards without photographs if the applicant has
9  a bona fide religious objection to being photographed or to
10  the display of his or her photograph. If the applicant so
11  requests, the card shall include a description of the
12  applicant's disability and any information about the
13  applicant's disability or medical history which the Secretary
14  determines would be helpful to the applicant in securing
15  emergency medical care. If a mark is used in lieu of a
16  signature, such mark shall be affixed to the card in the
17  presence of two witnesses who attest to the authenticity of
18  the mark. The Illinois Person with a Disability Identification
19  Card may be used for identification purposes in any lawful
20  situation by the person to whom it was issued.
21  The Illinois Person with a Disability Identification Card
22  may be used as adequate documentation of disability in lieu of
23  a physician's determination of disability, a determination of
24  disability from a physician assistant, a determination of
25  disability from an advanced practice registered nurse, or any
26  other documentation of disability whenever any State law

1  requires that a person with a disability provide such
2  documentation of disability, however an Illinois Person with a
3  Disability Identification Card shall not qualify the
4  cardholder to participate in any program or to receive any
5  benefit which is not available to all persons with like
6  disabilities. Notwithstanding any other provisions of law, an
7  Illinois Person with a Disability Identification Card, or
8  evidence that the Secretary of State has issued an Illinois
9  Person with a Disability Identification Card, shall not be
10  used by any person other than the person named on such card to
11  prove that the person named on such card is a person with a
12  disability or for any other purpose unless the card is used for
13  the benefit of the person named on such card, and the person
14  named on such card consents to such use at the time the card is
15  so used.
16  An optometrist's determination of a visual disability
17  under Section 4A of this Act is acceptable as documentation
18  for the purpose of issuing an Illinois Person with a
19  Disability Identification Card.
20  When medical information is contained on an Illinois
21  Person with a Disability Identification Card, the Office of
22  the Secretary of State shall not be liable for any actions
23  taken based upon that medical information.
24  (c) The Secretary of State shall provide that each
25  original or renewal Illinois Identification Card or Illinois
26  Person with a Disability Identification Card issued to a

1  person under the age of 21 shall be of a distinct nature from
2  those Illinois Identification Cards or Illinois Person with a
3  Disability Identification Cards issued to individuals 21 years
4  of age or older. The color designated for Illinois
5  Identification Cards or Illinois Person with a Disability
6  Identification Cards for persons under the age of 21 shall be
7  at the discretion of the Secretary of State.
8  (c-1) Each original or renewal Illinois Identification
9  Card or Illinois Person with a Disability Identification Card
10  issued to a person under the age of 21 shall display the date
11  upon which the person becomes 18 years of age and the date upon
12  which the person becomes 21 years of age.
13  (c-3) The General Assembly recognizes the need to identify
14  military veterans living in this State for the purpose of
15  ensuring that they receive all of the services and benefits to
16  which they are legally entitled, including healthcare,
17  education assistance, and job placement. To assist the State
18  in identifying these veterans and delivering these vital
19  services and benefits, the Secretary of State is authorized to
20  issue Illinois Identification Cards and Illinois Person with a
21  Disability Identification Cards with the word "veteran"
22  appearing on the face of the cards. This authorization is
23  predicated on the unique status of veterans. The Secretary may
24  not issue any other identification card which identifies an
25  occupation, status, affiliation, hobby, or other unique
26  characteristics of the identification card holder which is

1  unrelated to the purpose of the identification card.
2  (c-5) Beginning on or before July 1, 2015, the Secretary
3  of State shall designate a space on each original or renewal
4  identification card where, at the request of the applicant,
5  the word "veteran" shall be placed. The veteran designation
6  shall be available to a person identified as a veteran under
7  subsection (b) of Section 5 of this Act who was discharged or
8  separated under honorable conditions.
9  (d) The Secretary of State may issue a Senior Citizen
10  discount card, to any natural person who is a resident of the
11  State of Illinois who is 60 years of age or older and who
12  applies for such a card or renewal thereof. The Secretary of
13  State shall charge no fee to issue such card. The card shall be
14  issued in every county and applications shall be made
15  available at, but not limited to, nutrition sites, senior
16  citizen centers and Area Agencies on Aging. The applicant,
17  upon receipt of such card and prior to its use for any purpose,
18  shall have affixed thereon in the space provided therefor his
19  signature or mark.
20  (e) The Secretary of State, in his or her discretion, may
21  designate on each Illinois Identification Card or Illinois
22  Person with a Disability Identification Card a space where the
23  card holder may place a sticker or decal, issued by the
24  Secretary of State, of uniform size as the Secretary may
25  specify, that shall indicate in appropriate language that the
26  card holder has renewed his or her Illinois Identification

10  Person with a Disability Identification Card must also submit
11  with each original or renewal application, on forms prescribed
12  by the Secretary, such documentation as the Secretary may
13  require, establishing that the applicant is a "person with a

17  subsection (a), "peace officer" means any person who by virtue
18  of his or her office or public employment is vested by law with

23  (a-5) Upon the first issuance of a request for proposals
24  for a digital driver's license and identification card
25  issuance and facial recognition system issued after January 1,

2  that request for proposals, the Secretary shall permit
3  applicants to choose between "male", "female", or "non-binary"
4  when designating the applicant's sex on the identification
5  card application form. The sex designated by the applicant
6  shall be displayed on the identification card issued to the
7  applicant.
8  (b) Beginning on or before July 1, 2015, for each original
9  or renewal identification card application under this Act, the
10  Secretary shall inquire as to whether the applicant is a
11  veteran for purposes of issuing an identification card with a
12  veteran designation under subsection (c-5) of Section 4 of
13  this Act. The acceptable forms of proof shall include, but are
14  not limited to, Department of Defense form DD-214, Department
15  of Defense form DD-256 for applicants who did not receive a
16  form DD-214 upon the completion of initial basic training,
17  Department of Defense form DD-2 (Retired), an identification
18  card issued under the federal Veterans Identification Card Act
19  of 2015, or a United States Department of Veterans Affairs
20  summary of benefits letter. If the document cannot be stamped,
21  the Illinois Department of Veterans' Affairs shall provide a
22  certificate to the veteran to provide to the Secretary of
23  State. The Illinois Department of Veterans' Affairs shall
24  advise the Secretary as to what other forms of proof of a
25  person's status as a veteran are acceptable.

11  as a veteran, or the identification card will be cancelled.
12  For purposes of this subsection (b):
13  "Armed forces" means any of the Armed Forces of the United
14  States, including a member of any reserve component or
15  National Guard unit.

17  forces and was discharged or separated under honorable
18  conditions.

14  identification document validly issued to the applicant by a
15  consulate of that country as defined in Section 5 of the

17  be either unexpired or presented by an applicant within 2
18  years of its expiration date.

6  (d) Accept, hold, maintain, and administer, as trustee,
7  property given in trust for education or historic purposes for
8  the benefit of the people of the State of Illinois and dispose
9  of any property under the terms of the instrument creating the
10  trust.
11  (e) Accept, hold, maintain, and administer donated
12  property of historical significance, such as books, papers,
13  records, and personal property of any kind, including
14  electronic and digital property, pursuant to gifting
15  instruments, agreements, or deeds of gift, including but not
16  limited to the King Hostick Public Trust Fund, and enter into
17  such agreements as may be necessary to carry out the Board's
18  duties and responsibilities under this Section.
19  (f) Lease concessions at the Library and Museum. All
20  leases, for whatever period, shall be made subject to the
21  written approval of the Governor's Office of Management and
22  Budget. All concession leases extending for a period in excess
23  of 10 years shall contain provisions for the Agency to
24  participate, on a percentage basis, in the revenues generated
25  by any concession operation.

3  the State of Illinois by providing areas and the use of staff
4  personnel where feasible for the sale of publications on the

6  made by Illinois craftsmen. These sales shall not conflict
7  with existing concession agreements. The Board is authorized
8  to negotiate and approve agreements with the organizations and
9  agencies for a portion of the moneys received from sales to be
10  returned to the Agency for the furtherance of interpretative
11  and restoration programs.
12  (i) Accept offers of gifts, gratuities, or grants from the
13  federal government, its agencies, or offices, or from any
14  person, firm, or corporation.
15  (j) Subject to the provisions of the Illinois
16  Administrative Procedure Act, make reasonable rules as may be
17  necessary to discharge the duties of the Agency.
18  (k) Charge and collect admission fees and rental for
19  access to and use of the facilities of the Library and Museum;
20  however, an Illinois resident who shows a driver's license or
21  Illinois Identification Card containing a designation that the
22  resident is a Gold Star Family member shall not be charged an
23  admission fee for entry to the Museum during its normal hours
24  of operation.
25  (l) Operate a restaurant, cafe, or other food serving
26  facility at the Museum or lease the operation of such a

7  may take all necessary steps with respect to products and
8  services, including, but not limited to, retail sales,
9  wholesale sales, direct marketing, mail order sales, telephone
10  sales, advertising and promotion, purchase of product and
11  materials inventory, design and printing and manufacturing of
12  new products, reproductions, and adaptations, copyright and
13  trademark licensing and royalty agreements, and payment of
14  applicable taxes. In addition, the Board shall have the
15  authority to sell advertising in its publications and printed
16  materials.

1  (70 ILCS 1290/1) (from Ch. 105, par. 326)
2  Sec. 1. Erect, operate, and maintain aquariums and
3  museums. The corporate authorities of cities and park
4  districts having control or supervision over any public park
5  or parks, including parks located on formerly submerged land,
6  are hereby authorized to purchase, erect, and maintain within
7  any such public park or parks edifices to be used as aquariums
8  or as museums of art, industry, science, or natural or other
9  history, including presidential libraries, centers, and
10  museums, such aquariums and museums consisting of all
11  facilities for their collections, exhibitions, programming,
12  and associated initiatives, or to permit the directors or
13  trustees of any corporation or society organized for the
14  construction or maintenance and operation of an aquarium or
15  museum as hereinabove described to erect, enlarge, ornament,
16  build, rebuild, rehabilitate, improve, maintain, and operate
17  its aquarium or museum within any public park now or hereafter
18  under the control or supervision of any city or park district,
19  and to contract with any such directors or trustees of any such
20  aquarium or museum relative to the erection, enlargement,
21  ornamentation, building, rebuilding, rehabilitation,
22  improvement, maintenance, ownership, and operation of such
23  aquarium or museum. Notwithstanding the previous sentence, a
24  city or park district may enter into a lease for an initial
25  term not to exceed 99 years, subject to renewal, allowing a

1  corporation or society as hereinabove described to erect,
2  enlarge, ornament, build, rebuild, rehabilitate, improve,
3  maintain, and operate its aquarium or museum, together with
4  grounds immediately adjacent to such aquarium or museum, and
5  to use, possess, and occupy grounds surrounding such aquarium
6  or museum as hereinabove described for the purpose of
7  beautifying and maintaining such grounds in a manner
8  consistent with the aquarium or museum's purpose, and on the
9  conditions that (1) the public is allowed access to such
10  grounds in a manner consistent with its access to other public
11  parks, and (2) the city or park district retains a
12  reversionary interest in any improvements made by the
13  corporation or society on the grounds, including the aquarium
14  or museum itself, that matures upon the expiration or lawful
15  termination of the lease. It is hereby reaffirmed and found
16  that the aquariums and museums as described in this Section,
17  and their collections, exhibitions, programming, and
18  associated initiatives, serve valuable public purposes,
19  including, but not limited to, furthering human knowledge and
20  understanding, educating and inspiring the public, and
21  expanding recreational and cultural resources and
22  opportunities. Any city or park district may charge, or permit
23  such an aquarium or museum to charge, an admission fee. Any
24  such aquarium or museum, however, shall be open without
25  charge, when accompanied by a teacher, to the children in
26  actual attendance upon grades kindergarten through twelve in

1  any of the schools in this State at all times. In addition,
2  except as otherwise provided in this Section, any such
3  aquarium or museum must be open to persons who reside in this
4  State without charge for a period equivalent to 52 days, at
5  least 6 of which must be during the period from June through
6  August, each year. Beginning on the effective date of this
7  amendatory Act of the 101st General Assembly through June 30,
8  2022, any such aquarium or museum must be open to persons who
9  reside in this State without charge for a period equivalent to
10  52 days, at least 6 of which must be during the period from
11  June through August, 2021. Any such museum shall be open
12  without charge throughout the year to an Illinois resident who
13  shows a driver's license or Illinois Identification Card
14  containing a designation that the resident is a Gold Star
15  Family member. Notwithstanding said provisions, charges may be
16  made at any time for special services and for admission to
17  special facilities within any aquarium or museum for the
18  education, entertainment, or convenience of visitors. The
19  proceeds of such admission fees and charges for special
20  services and special facilities shall be devoted exclusively
21  to the purposes for which the tax authorized by Section 2
22  hereof may be used. If any owner or owners of any lands or lots
23  abutting or fronting on any such public park, or adjacent
24  thereto, have any private right, easement, interest or
25  property in such public park appurtenant to their lands or
26  lots or otherwise, which would be interfered with by the

1  erection and maintenance of any aquarium or museum as
2  hereinbefore provided, or any right to have such public park
3  remain open or vacant and free from buildings, the corporate
4  authorities of the city or park district having control of
5  such park, may condemn the same in the manner prescribed for
6  the exercise of the right of eminent domain under the Eminent
7  Domain Act. The changes made to this Section by this
8  amendatory Act of the 99th General Assembly are declaratory of
9  existing law and shall not be construed as a new enactment.

11  Section 25. The Illinois Vehicle Code is amended by
12  changing Sections 3-699.14, 6-106, and 6-110 as follows:

14  Sec. 3-699.14. Universal special license plates.
15  (a) In addition to any other special license plate, the
16  Secretary, upon receipt of all applicable fees and
17  applications made in the form prescribed by the Secretary, may
18  issue Universal special license plates to residents of
19  Illinois on behalf of organizations that have been authorized
20  by the General Assembly to issue decals for Universal special
21  license plates. Appropriate documentation, as determined by
22  the Secretary, shall accompany each application. Authorized
23  organizations shall be designated by amendment to this

1  the applicant shall inform the Secretary of the name of the
2  authorized organization from which the applicant will obtain a
3  decal to place on the plate. The Secretary shall make a record
4  of that organization and that organization shall remain
5  affiliated with that plate until the plate is surrendered,
6  revoked, or otherwise cancelled. The authorized organization
7  may charge a fee to offset the cost of producing and
8  distributing the decal, but that fee shall be retained by the
9  authorized organization and shall be separate and distinct
10  from any registration fees charged by the Secretary. No decal,
11  sticker, or other material may be affixed to a Universal
12  special license plate other than a decal authorized by the
13  General Assembly in this Section or a registration renewal
14  sticker. The special plates issued under this Section shall be
15  affixed only to passenger vehicles of the first division,
16  including motorcycles and autocycles, or motor vehicles of the
17  second division weighing not more than 8,000 pounds. Plates
18  issued under this Section shall expire according to the
19  multi-year procedure under Section 3-414.1 of this Code.
20  (b) The design, color, and format of the Universal special
21  license plate shall be wholly within the discretion of the
22  Secretary. Universal special license plates are not required
23  to designate "Land of Lincoln", as prescribed in subsection
24  (b) of Section 3-412 of this Code. The design shall allow for
25  the application of a decal to the plate. Organizations

1  Universal special license plates shall comply with rules
2  adopted by the Secretary governing the requirements for and
3  approval of Universal special license plate decals. The
4  Secretary may, in his or her discretion, allow Universal
5  special license plates to be issued as vanity or personalized
6  plates in accordance with Section 3-405.1 of this Code. The
7  Secretary of State must make a version of the special
8  registration plates authorized under this Section in a form
9  appropriate for motorcycles and autocycles.
10  (c) When authorizing a Universal special license plate,
11  the General Assembly shall set forth whether an additional fee
12  is to be charged for the plate and, if a fee is to be charged,
13  the amount of the fee and how the fee is to be distributed.
14  When necessary, the authorizing language shall create a
15  special fund in the State treasury into which fees may be
16  deposited for an authorized Universal special license plate.
17  Additional fees may only be charged if the fee is to be paid
18  over to a State agency or to a charitable entity that is in
19  compliance with the registration and reporting requirements of
20  the Charitable Trust Act and the Solicitation for Charity Act.
21  Any charitable entity receiving fees for the sale of Universal
22  special license plates shall annually provide the Secretary of
23  State a letter of compliance issued by the Attorney General
24  verifying that the entity is in compliance with the Charitable
25  Trust Act and the Solicitation for Charity Act.

2  fee, if applicable, the Secretary shall collect any additional
3  fees, if required, for issuance of Universal special license
4  plates. The fees shall be collected on behalf of the
5  organization designated by the applicant when applying for the
6  plate. All fees collected shall be transferred to the State
7  agency on whose behalf the fees were collected, or paid into
8  the special fund designated in the law authorizing the
9  organization to issue decals for Universal special license
10  plates. All money in the designated fund shall be distributed
11  by the Secretary subject to appropriation by the General
12  Assembly.
13  (e) The following organizations may issue decals for
14  Universal special license plates with the original and renewal
15  fees and fee distribution as follows:
16  (1) The Illinois Department of Natural Resources.
17  (A) Original issuance: $25; with $10 to the
18  Roadside Monarch Habitat Fund and $15 to the Secretary
19  of State Special License Plate Fund.
20  (B) Renewal: $25; with $23 to the Roadside Monarch

13  Sec. 6-106. Application for license or instruction permit.
14  (a) Every application for any permit or license authorized
15  to be issued under this Code shall be made upon a form
16  furnished by the Secretary of State. Every application shall
17  be accompanied by the proper fee and payment of such fee shall
18  entitle the applicant to not more than 3 attempts to pass the
19  examination within a period of one year after the date of
20  application.
21  (b) Every application shall state the legal name, social
22  security number, zip code, date of birth, sex, and residence
23  address of the applicant; briefly describe the applicant;
24  state whether the applicant has theretofore been licensed as a
25  driver, and, if so, when and by what state or country, and

1  whether any such license has ever been cancelled, suspended,
2  revoked or refused, and, if so, the date and reason for such
3  cancellation, suspension, revocation or refusal; shall include
4  an affirmation by the applicant that all information set forth
5  is true and correct; and shall bear the applicant's signature.
6  In addition to the residence address, the Secretary may allow
7  the applicant to provide a mailing address. In the case of an
8  applicant who is a judicial officer or peace officer, the
9  Secretary may allow the applicant to provide an office or work
10  address in lieu of a residence or mailing address. The
11  application form may also require the statement of such
12  additional relevant information as the Secretary of State
13  shall deem necessary to determine the applicant's competency
14  and eligibility. The Secretary of State may, in his
15  discretion, by rule or regulation, provide that an application
16  for a drivers license or permit may include a suitable
17  photograph of the applicant in the form prescribed by the
18  Secretary, and he may further provide that each drivers
19  license shall include a photograph of the driver. The
20  Secretary of State may utilize a photograph process or system
21  most suitable to deter alteration or improper reproduction of
22  a drivers license and to prevent substitution of another photo
23  thereon. For the purposes of this subsection (b), "peace
24  officer" means any person who by virtue of his or her office or
25  public employment is vested by law with a duty to maintain
26  public order or to make arrests for a violation of any penal

1  statute of this State, whether that duty extends to all
2  violations or is limited to specific violations.
3  (b-3) Upon the first issuance of a request for proposals
4  for a digital driver's license and identification card
5  issuance and facial recognition system issued after January 1,
6  2020 (the effective date of Public Act 101-513), and upon
7  implementation of a new or revised system procured pursuant to
8  that request for proposals, the Secretary shall permit
9  applicants to choose between "male", "female" or "non-binary"
10  when designating the applicant's sex on the driver's license
11  application form. The sex designated by the applicant shall be
12  displayed on the driver's license issued to the applicant.
13  (b-5) Every applicant for a REAL ID compliant driver's
14  license or permit shall provide proof of lawful status in the
15  United States as defined in 6 CFR 37.3, as amended. Applicants
16  who are unable to provide the Secretary with proof of lawful
17  status may apply for a driver's license or permit under
18  Section 6-105.1 of this Code.
19  (c) The application form shall include a notice to the
20  applicant of the registration obligations of sex offenders
21  under the Sex Offender Registration Act. The notice shall be
22  provided in a form and manner prescribed by the Secretary of
23  State. For purposes of this subsection (c), "sex offender" has
24  the meaning ascribed to it in Section 2 of the Sex Offender
25  Registration Act.
26  (d) Any male United States citizen or immigrant who

1  applies for any permit or license authorized to be issued
2  under this Code or for a renewal of any permit or license, and
3  who is at least 18 years of age but less than 26 years of age,
4  must be registered in compliance with the requirements of the
5  federal Military Selective Service Act. The Secretary of State
6  must forward in an electronic format the necessary personal
7  information regarding the applicants identified in this
8  subsection (d) to the Selective Service System. The
9  applicant's signature on the application serves as an
10  indication that the applicant either has already registered
11  with the Selective Service System or that he is authorizing
12  the Secretary to forward to the Selective Service System the
13  necessary information for registration. The Secretary must
14  notify the applicant at the time of application that his
15  signature constitutes consent to registration with the
16  Selective Service System, if he is not already registered.
17  (e) Beginning on or before July 1, 2015, for each original
18  or renewal driver's license application under this Code, the
19  Secretary shall inquire as to whether the applicant is a
20  veteran for purposes of issuing a driver's license with a
21  veteran designation under subsection (e-5) of Section 6-110 of
22  this Code. The acceptable forms of proof shall include, but
23  are not limited to, Department of Defense form DD-214,
24  Department of Defense form DD-256 for applicants who did not
25  receive a form DD-214 upon the completion of initial basic
26  training, Department of Defense form DD-2 (Retired), an

1  identification card issued under the federal Veterans
2  Identification Card Act of 2015, or a United States Department
3  of Veterans Affairs summary of benefits letter. If the
4  document cannot be stamped, the Illinois Department of
5  Veterans' Affairs shall provide a certificate to the veteran
6  to provide to the Secretary of State. The Illinois Department
7  of Veterans' Affairs shall advise the Secretary as to what
8  other forms of proof of a person's status as a veteran are
9  acceptable.
10  For each applicant who is issued a driver's license with a
11  veteran designation, the Secretary shall provide the
12  Department of Veterans' Affairs with the applicant's name,
13  address, date of birth, gender and such other demographic
14  information as agreed to by the Secretary and the Department.
15  The Department may take steps necessary to confirm the
16  applicant is a veteran. If after due diligence, including
17  writing to the applicant at the address provided by the
18  Secretary, the Department is unable to verify the applicant's
19  veteran status, the Department shall inform the Secretary, who
20  shall notify the applicant that he or she must confirm status
21  as a veteran, or the driver's license will be cancelled.
22  For purposes of this subsection (e):
23  "Armed forces" means any of the Armed Forces of the United
24  States, including a member of any reserve component or
25  National Guard unit.
26  "Veteran" means a person who has served in the armed

3  (f) An applicant who is eligible for Gold Star license
4  plates under Section 3-664 of this Code may apply for an
5  original or renewal driver's license with space for a
6  designation as a Gold Star Family. The Secretary may waive any
7  fee for this application. If the Secretary does not waive the
8  fee, any fee charged to the applicant must be deposited into
9  the Illinois Veterans Assistance Fund. The Secretary is
10  authorized to issue rules to implement this subsection.

1  public order or to make arrests for a violation of any penal
2  statute of this State, whether that duty extends to all
3  violations or is limited to specific violations.
4  (b-1) Every application shall state the social security
5  number of the applicant; except if the applicant is applying
6  for a standard driver's license and, on the date of
7  application, is ineligible for a social security number, then:
8  (1) if the applicant has documentation, issued by the
9  United States Department of Homeland Security, authorizing
10  the applicant's presence in this country, the applicant
11  shall provide such documentation instead of a social
12  security number; and
13  (2) if the applicant does not have documentation
14  described in paragraph (1), the applicant shall provide,
15  instead of a social security number, the following:
16  (A) documentation establishing that the applicant
17  has resided in this State for a period in excess of one
18  year;
19  (B) a passport validly issued to the applicant
20  from the applicant's country of citizenship or a
21  consular identification document validly issued to the
22  applicant by a consulate of that country as defined in
23  Section 5 of the Consular Identification Document Act,
24  as long as such documents are either unexpired or
25  presented by an applicant within 2 years of its
26  expiration date; and

10  Sec. 6-110. Licenses issued to drivers.
11  (a) The Secretary of State shall issue to every qualifying
12  applicant a driver's license as applied for, which license
13  shall bear a distinguishing number assigned to the licensee,
14  the legal name, signature, zip code, date of birth, residence
15  address, and a brief description of the licensee.
16  Licenses issued shall also indicate the classification and
17  the restrictions under Section 6-104 of this Code. The
18  Secretary may adopt rules to establish informational
19  restrictions that can be placed on the driver's license
20  regarding specific conditions of the licensee.
21  A driver's license issued may, in the discretion of the
22  Secretary, include a suitable photograph of a type prescribed
23  by the Secretary.
24  (a-1) If the licensee is less than 18 years of age, unless
25  one of the exceptions in subsection (a-2) apply, the license

1  shall, as a matter of law, be invalid for the operation of any
2  motor vehicle during the following times:
3  (A) Between 11:00 p.m. Friday and 6:00 a.m. Saturday;
4  (B) Between 11:00 p.m. Saturday and 6:00 a.m. on
5  Sunday; and
6  (C) Between 10:00 p.m. on Sunday to Thursday,
7  inclusive, and 6:00 a.m. on the following day.
8  (a-2) The driver's license of a person under the age of 18
9  shall not be invalid as described in subsection (a-1) of this
10  Section if the licensee under the age of 18 was:
11  (1) accompanied by the licensee's parent or guardian
12  or other person in custody or control of the minor;
13  (2) on an errand at the direction of the minor's
14  parent or guardian, without any detour or stop;
15  (3) in a motor vehicle involved in interstate travel;
16  (4) going to or returning home from an employment
17  activity, without any detour or stop;
18  (5) involved in an emergency;
19  (6) going to or returning home from, without any
20  detour or stop, an official school, religious, or other
21  recreational activity supervised by adults and sponsored
22  by a government or governmental agency, a civic
23  organization, or another similar entity that takes
24  responsibility for the licensee, without any detour or
25  stop;
26  (7) exercising First Amendment rights protected by the

1  United States Constitution, such as the free exercise of
2  religion, freedom of speech, and the right of assembly; or
3  (8) married or had been married or is an emancipated
4  minor under the Emancipation of Minors Act.
5  (a-2.5) The driver's license of a person who is 17 years of
6  age and has been licensed for at least 12 months is not invalid
7  as described in subsection (a-1) of this Section while the
8  licensee is participating as an assigned driver in a Safe
9  Rides program that meets the following criteria:
10  (1) the program is sponsored by the Boy Scouts of
11  America or another national public service organization;
12  and
13  (2) the sponsoring organization carries liability
14  insurance covering the program.
15  (a-3) If a graduated driver's license holder over the age
16  of 18 committed an offense against traffic regulations
17  governing the movement of vehicles or any violation of Section
18  6-107 or Section 12-603.1 of this Code in the 6 months prior to
19  the graduated driver's license holder's 18th birthday, and was
20  subsequently convicted of the offense, the provisions of
21  subsection (a-1) shall continue to apply until such time as a
22  period of 6 consecutive months has elapsed without an
23  additional violation and subsequent conviction of an offense
24  against traffic regulations governing the movement of vehicles
25  or Section 6-107 or Section 12-603.1 of this Code.

1  instruction permit has a current identification card issued by
2  the Secretary of State, the Secretary may require the
3  applicant to utilize the same residence address and name on
4  the identification card, driver's license, and instruction
5  permit records maintained by the Secretary. The Secretary may
6  promulgate rules to implement this provision.
7  (a-5) If an applicant for a driver's license is a judicial
8  officer or a peace officer, the applicant may elect to have his
9  or her office or work address listed on the license instead of
10  the applicant's residence or mailing address. The Secretary of
11  State shall adopt rules to implement this subsection (a-5).
12  For the purposes of this subsection (a-5), "peace officer"
13  means any person who by virtue of his or her office or public
14  employment is vested by law with a duty to maintain public
15  order or to make arrests for a violation of any penal statute
16  of this State, whether that duty extends to all violations or
17  is limited to specific violations.
18  (b) Until the Secretary of State establishes a First
19  Person Consent organ and tissue donor registry under Section
20  6-117 of this Code, the Secretary of State shall provide a
21  format on the reverse of each driver's license issued which
22  the licensee may use to execute a document of gift conforming
23  to the provisions of the Illinois Anatomical Gift Act. The
24  format shall allow the licensee to indicate the gift intended,
25  whether specific organs, any organ, or the entire body, and
26  shall accommodate the signatures of the donor and 2 witnesses.

1  The Secretary shall also inform each applicant or licensee of
2  this format, describe the procedure for its execution, and may
3  offer the necessary witnesses; provided that in so doing, the
4  Secretary shall advise the applicant or licensee that he or
5  she is under no compulsion to execute a document of gift. A
6  brochure explaining this method of executing an anatomical
7  gift document shall be given to each applicant or licensee.
8  The brochure shall advise the applicant or licensee that he or
9  she is under no compulsion to execute a document of gift, and
10  that he or she may wish to consult with family, friends or
11  clergy before doing so. The Secretary of State may undertake
12  additional efforts, including education and awareness
13  activities, to promote organ and tissue donation.
14  (c) The Secretary of State shall designate on each
15  driver's license issued a space where the licensee may place a
16  sticker or decal of the uniform size as the Secretary may
17  specify, which sticker or decal may indicate in appropriate
18  language that the owner of the license carries an Emergency
19  Medical Information Card.
20  The sticker may be provided by any person, hospital,
21  school, medical group, or association interested in assisting
22  in implementing the Emergency Medical Information Card, but
23  shall meet the specifications as the Secretary may by rule or
24  regulation require.
25  (d) The Secretary of State shall designate on each
26  driver's license issued a space where the licensee may

2  (e) The Secretary of State shall provide that each
3  original or renewal driver's license issued to a licensee
4  under 21 years of age shall be of a distinct nature from those
5  driver's licenses issued to individuals 21 years of age and
6  older. The color designated for driver's licenses for
7  licensees under 21 years of age shall be at the discretion of
8  the Secretary of State.
9  (e-1) The Secretary shall provide that each driver's
10  license issued to a person under the age of 21 displays the
11  date upon which the person becomes 18 years of age and the date
12  upon which the person becomes 21 years of age.
13  (e-3) The General Assembly recognizes the need to identify
14  military veterans living in this State for the purpose of
15  ensuring that they receive all of the services and benefits to
16  which they are legally entitled, including healthcare,
17  education assistance, and job placement. To assist the State
18  in identifying these veterans and delivering these vital
19  services and benefits, the Secretary of State is authorized to
20  issue drivers' licenses with the word "veteran" appearing on
21  the face of the licenses. This authorization is predicated on
22  the unique status of veterans. The Secretary may not issue any
23  other driver's license which identifies an occupation, status,
24  affiliation, hobby, or other unique characteristics of the
25  license holder which is unrelated to the purpose of the
26  driver's license.

1  (e-5) Beginning on or before July 1, 2015, the Secretary
2  of State shall designate a space on each original or renewal
3  driver's license where, at the request of the applicant, the
4  word "veteran" shall be placed. The veteran designation shall
5  be available to a person identified as a veteran under
6  subsection (e) of Section 6-106 of this Code who was
7  discharged or separated under honorable conditions.
8  (e-7) Upon providing required documentation, at the
9  request of the applicant, the driver's license may reflect
10  Gold Star Family designation. The Secretary shall designate a
11  space on each original or renewal driver's license for such
12  designation. This designation shall be available to a person
13  eligible for Gold Star license plates under subsection (f) of
14  Section 6-106 of this Code.
15  (f) The Secretary of State shall inform all Illinois
16  licensed commercial motor vehicle operators of the
17  requirements of the Uniform Commercial Driver License Act,
18  Article V of this Chapter, and shall make provisions to insure
19  that all drivers, seeking to obtain a commercial driver's
20  license, be afforded an opportunity prior to April 1, 1992, to
21  obtain the license. The Secretary is authorized to extend
22  driver's license expiration dates, and assign specific times,
23  dates and locations where these commercial driver's tests
24  shall be conducted. Any applicant, regardless of the current
25  expiration date of the applicant's driver's license, may be
26  subject to any assignment by the Secretary. Failure to comply

1  with the Secretary's assignment may result in the applicant's
2  forfeiture of an opportunity to receive a commercial driver's
3  license prior to April 1, 1992.
4  (g) The Secretary of State shall designate on a driver's
5  license issued, a space where the licensee may indicate that
6  he or she has drafted a living will in accordance with the
7  Illinois Living Will Act or a durable power of attorney for
8  health care in accordance with the Illinois Power of Attorney
9  Act.
10  (g-1) The Secretary of State, in his or her discretion,
11  may designate on each driver's license issued a space where
12  the licensee may place a sticker or decal, issued by the
13  Secretary of State, of uniform size as the Secretary may
14  specify, that shall indicate in appropriate language that the
15  owner of the license has renewed his or her driver's license.
16  (h) A person who acts in good faith in accordance with the
17  terms of this Section is not liable for damages in any civil
18  action or subject to prosecution in any criminal proceeding
19  for his or her act.
20  (i) The Secretary shall designate a space on each original
21  or renewal of a driver's license, at the request of the
22  applicant, for a designation as a Gold Star Family. This
23  designation shall be available to a person eligible for Gold
24  Star license plates under subsection (f) of Section 6-106 of
25  this Code.
