1 AN ACT concerning commuter passenger rail service.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Transportation Cooperation Act of 1971 is
5 amended by adding Section 7.5 as follows:
6 (5 ILCS 225/7.5 new)
7 Sec. 7.5. Rail safety recommendation report.
8 (a) A railroad passenger service or Association shall
9 issue an annual report on or before December 31 of each year
10 containing all rail safety recommendations made by the
11 National Transportation Safety Board during the previous 12
12 months and the status of the service's or Association's
13 implementation of those recommendations. The report shall be
14 made publicly available on the website of the rail passenger
15 service or Association.
16 (b) The Federal Railroad Corporation may issue an annual
17 report on or before December 31 of each year containing all
18 rail safety recommendations made by the National
19 Transportation Safety Board during the previous 12 months and
20 the status of the Corporation's implementation of those
21 recommendations. If the Corporation voluntarily issues a
22 report under this subsection, the Corporation shall make the
23 report publicly available on the Corporation's website.

1 Section 10. The Department of Transportation Law of the
2 Civil Administrative Code of Illinois is amended by adding
3 Section 2705-423 as follows:
4 (20 ILCS 2705/2705-423 new)
5 Sec. 2705-423. Rail safety recommendation report. The
6 Department shall issue an annual report on or before December
7 31 of each year containing all rail safety recommendations
8 made by the National Transportation Safety Board during the
9 previous 12 months and the status of the Department's
10 implementation of those recommendations. The report shall be
11 made publicly available on the Department's website.
12 Section 15. The Bi-State Development Agency Act is amended
13 by adding Section 8.5 as follows:
14 (45 ILCS 105/8.5 new)
15 Sec. 8.5. Rail safety recommendation report. The Bi-State
16 Development Agency may issue an annual report on or before
17 December 31 of each year containing all rail safety
18 recommendations made by the National Transportation Safety
19 Board during the previous 12 months and the status of the
20 Corporation's implementation of those recommendations. If the
21 Bi-State Development Agency voluntarily issues a report under
22 this Section, the Bi-State Development Agency shall make the

1 report publicly available on the Agency's website.

3 Section 20. The Regional Transportation Authority Act is
4 amended by adding Section 5.15 as follows:
5 (70 ILCS 3615/5.15 new)
6 Sec. 5.15. Rail safety recommendation report. The Regional
7 Transportation Authority, the Chicago Transit Authority, and
8 the Commuter Rail Division shall issue an annual report on or
9 before December 31 of each year containing all rail safety
10 recommendations made by the National Transportation Safety
11 Board during the previous 12 months and the status of the
12 Regional Transportation Authority's, the Chicago Transit
13 Authority's, and the Commuter Rail Division's implementation
14 of those recommendations, including for any recommendations
15 within the Regional Transportation Authority's
16 extra-territorial authority, if any. The reports shall be made
17 publicly available on the Regional Transportation Authority's
18 website.
