                    104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB0017 Introduced , by Rep. Travis Weaver SYNOPSIS AS INTRODUCED: 20 ILCS 405/405-546 new Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that, within 6 months after the effective date of the amendatory Act, the Department of Central Management Services, in conjunction with the 5 State-funded retirement systems, may enter into a contract with an administrator to establish and conduct a State Retiree Medicare Primacy Coordination Audit and Assistance Program to identify relevant individuals eligible for Medicare but not enrolled in Medicare, and to assist those individuals with enrolling in Social Security and Medicare. Provides that the State Retiree Medicare Primacy Coordination Audit and Assistance Program shall conduct an annual audit of the State health benefits program for everyone covered under the State Employees Group Insurance Program, the Teachers' Retirement Insurance Program, and the College Insurance Program for the purpose of identifying participants and their dependents who are eligible for Medicare under federal law and shall also ensure that those annuitants, retirees, benefit recipients, survivors, or dependents who are eligible for Medicare are enrolled in Medicare with Medicare as their primary health care benefits coverage and the State Health Benefits Program being the secondary provider of their health care benefits coverage. Provides that the State Retiree Medicare Primacy Coordination Audit and Assistance Program shall assist any annuitant, retiree, benefit recipient, survivor or their dependents who becomes disabled, and is not enrolled in Social Security Disability Insurance and Medicare, with enrolling in and obtaining Social Security Disability Insurance and Medicare benefits. Provides that the administrator of the State Retiree Medicare Primacy Coordination Audit and Assistance Program shall provide the Department, the 5 State-funded retirement systems, and the General Assembly with an annual report. 2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Department of Central Management Services
5  Law of the Civil Administrative Code of Illinois is amended by
6  adding Section 405-546 as follows:

10  (a) Within 6 months after the effective date of this
11  amendatory Act of the 104th General Assembly, the Department
12  of Central Management Services, in conjunction with the State
13  Employees' Retirement System of Illinois, the State
14  Universities Retirement System, the Teachers' Retirement
15  System of the State of Illinois, the Judges' Retirement System
16  of Illinois, and the General Assembly Retirement System, may
17  enter into a contract with a qualified and experienced
18  administrator to establish and conduct a State Retiree
19  Medicare Primacy Coordination Audit and Assistance Program to
20  identify annuitants, retirees, benefit recipients, survivors,
21  or dependents who are eligible for Medicare, but not enrolled
22  in Medicare, and to assist those annuitants, retirees, benefit
23  recipients, survivors, or dependents with enrolling in Social

1  Security and Medicare.
2  (b) The State Retiree Medicare Primacy Coordination Audit
3  and Assistance Program shall conduct an annual audit of the
4  State health benefits program for everyone covered under the
5  State Employees Group Insurance Program, the Teachers'
6  Retirement Insurance Program, and the College Insurance
7  Program for the purpose of identifying participants and their
8  dependents who are eligible for Medicare under federal law.
9  The Program shall also ensure that those annuitants, retirees,
10  benefit recipients, survivors, or dependents who are eligible
11  for Medicare are enrolled in Medicare with Medicare as their
12  primary health care benefits coverage and the State Health
13  Benefits Program as the secondary provider of their health
14  care benefits coverage.
15  (c) The State Retiree Medicare Primacy Coordination Audit
16  and Assistance Program shall assist any annuitant, retiree,
17  benefit recipient, survivor or their dependents who becomes
18  disabled, and is not enrolled in Social Security Disability
19  Insurance and Medicare, with enrolling in and obtaining Social
20  Security Disability Insurance and Medicare benefits. This
21  assistance shall include, but not be limited to: (i)
22  developing communication materials to educate individuals
23  about Social Security Disability Insurance benefits; (ii)
24  performing multiple outreaches to targeted populations; (iii)
25  analyzing responses to determine Social Security Disability
26  Insurance eligibility; and (iv) representing qualified

1  individuals on their claim for Social Security Disability
2  Insurance and Medicare.
3  (d) The administrator shall provide the Department, the
4  State Employees' Retirement System of Illinois, the State
5  Universities Retirement System, the Teachers' Retirement
6  System of the State of Illinois, the Judges' Retirement System
7  of Illinois, the General Assembly Retirement System, and the
8  General Assembly with an annual report showing the number of
9  annuitants, retirees, benefit recipients, survivors, and
10  dependents who are transitioned to Social Security Disability
11  Insurance and Medicare and the amount of savings realized by
12  the State of Illinois.
