                    104TH GENERAL ASSEMBLY State of Illinois 2025 and 2026 HB1355 Introduced , by Rep. Mary Beth Canty SYNOPSIS AS INTRODUCED: 430 ILCS 15/8 new Amends the Gasoline Storage Act. Provides that, beginning on the effective date of the amendatory Act, no person shall construct or install a gas station, a motor fuel dispensary, or a motor fuel storage tank on or within 300 feet of school grounds. Provides that the Office of the State Fire Marshal shall adopt rules that implement these provisions and conform with the requirements of the Act. Defines terms. 1  AN ACT concerning safety.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Gasoline Storage Act is amended by adding
5  Section 8 as follows:
6  (430 ILCS 15/8 new)
7  Sec. 8. Construction of gas stations, motor fuel
8  dispensaries, and motor fuel storage tanks prohibited on or
9  near school grounds.
10  (a) In this Section:
11  "Gas station" means a place where motor fuel is sold at
12  retail for use in motor vehicles.
13  "Motor fuel" means gasoline, diesel fuel, gasohol, or
14  other volatile and inflammable liquids produced, blended, or
15  compounded for use in motor vehicles.
16  "Motor fuel dispensary" means a place where motor fuel is
17  dispensed for use in a motor vehicle.
18  "Motor fuel storage tank" means a tank used for the
19  storage of motor fuel.
20  "Motor vehicle" means a motor vehicle as defined in the
21  Illinois Vehicle Code.
22  "School grounds" means the real property upon which an
23  active and operational public, private, or parochial
