Nicolle Grasse SYNOPSIS AS INTRODUCED: 20 ILCS 2310/2310-600 Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that the Department of Public Health is vested with the duty and responsibility for oversight and training connected with the use of the Department of Public Health Uniform POLST form at all hospitals, healthcare facilities, and other facilities and providers that use the Department of Public Health Uniform POLST form. Provides that the Department of Public Health shall develop, in consultation with stakeholders determined by the Director of Public Health, training resources to support informed decisions and accurate completion of the Department of Public Health Uniform POLST form. Provides that the Department of Public Health shall establish a simple, efficient, and effective process to ensure oversight of and accountability for training to support informed decisions and accurate completion of the Department of Public Health Uniform POLST form at all hospitals, healthcare facilities, and other facilities and providers that use the Department of Public Health Uniform POLST form. Provides that, in consultation with various organizations, the Department of Public Health shall adopt rules implementing these policies no later than 2 years after the effective date of this amendatory Act. Provides that the Department of Public Health, in connection with implementing these policies, may also consult with the Office of the Secretary of State with respect to the Advance Directive Registry established by the Secretary of State. 1  AN ACT concerning State government.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Department of Public Health Powers and
5  Duties Law of the Civil Administrative Code of Illinois is
6  amended by changing Section 2310-600 as follows:
7  (20 ILCS 2310/2310-600)
8  Sec. 2310-600. Advance directive information.
9  (a) The Department of Public Health shall prepare and
10  publish the summary of advance directives law, as required by
11  the federal Patient Self-Determination Act, and related forms.
12  Publication may be limited to the World Wide Web. The summary
13  required under this subsection (a) must include the Department
14  of Public Health Uniform POLST form.
15  (b) The Department of Public Health shall publish Spanish
16  language versions of the following:
17  (1) The statutory Living Will Declaration form.
18  (2) The Illinois Statutory Short Form Power of
19  Attorney for Health Care.
20  (3) The statutory Declaration of Mental Health
21  Treatment Form.
22  (4) The summary of advance directives law in Illinois.

3  (b-5) In consultation with a statewide professional
4  organization representing physicians licensed to practice
5  medicine in all its branches, statewide organizations
6  representing physician assistants, advanced practice
7  registered nurses, nursing homes, registered professional
8  nurses, and emergency medical systems, and a statewide
9  organization representing hospitals, the Department of Public
10  Health shall develop and publish a uniform form for
11  practitioner cardiopulmonary resuscitation (CPR) or
12  life-sustaining treatment orders that may be utilized in all
13  settings. The form shall meet the published minimum
14  requirements to nationally be considered a practitioner orders
15  for life-sustaining treatment form, or POLST, and may be
16  referred to as the Department of Public Health Uniform POLST
17  form. An electronic version of the Uniform POLST form under
18  this Act may be created, signed, or revoked electronically
19  using a generic, technology-neutral system in which each user
20  is assigned a unique identifier that is securely maintained
21  and in a manner that meets the regulatory requirements for a
22  digital or electronic signature. Compliance with the standards
23  defined in the Uniform Electronic Transactions Act or the
24  implementing rules of the Hospital Licensing Act for medical
25  record entry authentication for author validation of the
26  documentation, content accuracy, and completeness meets this

1  standard. This form does not replace a physician's or other
2  practitioner's authority to make a do-not-resuscitate (DNR)
3  order.
4  (b-10) In consultation with a statewide professional
5  organization representing physicians licensed to practice
6  medicine in all its branches, statewide organizations
7  representing physician assistants, advanced practice
8  registered nurses, nursing homes, registered professional
9  nurses, and emergency medical systems, a statewide bar
10  association, a national bar association with an Illinois
11  chapter that concentrates in elder and disability law, a
12  not-for-profit organ procurement organization that coordinates
13  organ and tissue donation, a statewide committee or group
14  responsible for stakeholder education about POLST issues, and
15  a statewide organization representing hospitals, the
16  Department of Public Health shall study the feasibility of
17  creating a statewide registry of advance directives and POLST
18  forms. The registry would allow residents of this State to
19  submit the forms and for the forms to be made available to
20  health care providers and professionals in a timely manner for
21  the provision of care or services. This study must be filed
22  with the General Assembly on or before January 1, 2021.
23  (b-15) In consultation with a statewide professional
24  organization representing physicians licensed to practice

1  registered nurses, nursing homes, registered professional
2  nurses, and emergency medical systems, and a statewide
3  organization representing hospitals, the Department of Public
4  Health shall adopt rules implementing the policies established
5  under this subsection no later than 2 years after the
6  effective date of this amendatory Act of the 104th General
7  Assembly. The Department of Public Health, in connection with
8  implementing the policies established under this subsection,
9  may also consult with the Office of the Secretary of State with
10  respect to the Advance Directive Registry established by the
11  Secretary of State.
12  (1) The Department of Public Health is vested with the
