1  AN ACT concerning health.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Epinephrine Injector Act is amended by
5  changing Sections 5 and 10 and by adding Section 25 as follows:
6  (410 ILCS 27/5)
7  Sec. 5. Definitions. As used in this Act:
8  "Administer" means to directly apply an epinephrine
9  injector to the body of an individual.
10  "Authorized entity" means any entity or organization,
11  other than a school covered under Section 22-30 of the School
12  Code, in connection with or at which allergens capable of
13  causing anaphylaxis may be present, including, but not limited
14  to, independent contractors who provide student transportation
15  to schools, recreation camps, colleges and universities, day
16  care facilities, youth sports leagues, amusement parks,
17  restaurants, sports arenas, and places of employment. The
18  Department shall, by rule, determine what constitutes a day
19  care facility under this definition.
20  "Authorized individual" means an individual who has
21  successfully completed the training program under Section 10
22  of this Act.
23  "Department" means the Department of Public Health.

1  "Epinephrine injector" includes an auto-injector approved
2  by the United States Food and Drug Administration for the
3  administration of epinephrine and a pre-filled syringe
4  approved by the United States Food and Drug Administration and
5  used for the administration of epinephrine that contains a
6  pre-measured dose of epinephrine that is equivalent to the
7  dosages used in an auto-injector.
8  "Health care practitioner" means a physician licensed to
9  practice medicine in all its branches under the Medical
10  Practice Act of 1987, a physician assistant under the
11  Physician Assistant Practice Act of 1987 with prescriptive
12  authority, or an advanced practice registered nurse with
13  prescribing authority under Article 65 of the Nurse Practice
14  Act.
15  "Pharmacist" has the meaning given to that term under
16  subsection (k-5) of Section 3 of the Pharmacy Practice Act.
17  "Undesignated epinephrine injector" means an epinephrine
18  injector prescribed in the name of an authorized entity.

22  Sec. 10. Prescription to authorized entity; use; training.
23  (a) A health care practitioner may prescribe epinephrine
24  injectors in the name of an authorized entity for use in
25  accordance with this Act, and pharmacists and health care

1  practitioners may dispense epinephrine injectors pursuant to a
2  prescription issued in the name of an authorized entity. Such
3  prescriptions shall be valid for a period of 2 years.
4  (b) An authorized entity may acquire and stock a supply of
5  undesignated epinephrine injectors pursuant to a prescription
6  issued under subsection (a) of this Section. Such undesignated
7  epinephrine injectors shall be stored in a location readily
8  accessible in an emergency and in accordance with the
9  instructions for use of the epinephrine injectors. The
10  Department may establish any additional requirements an
11  authorized entity must follow under this Act.
12  (c) An employee or agent of an authorized entity who is an
13  authorized individual or any other other individual who is an
14  authorized individual has completed training under subsection
15  (d) of this Section may:
16  (1) provide an epinephrine injector to any individual
17  on the property of the authorized entity whom the
18  employee, agent, or other individual believes in good
19  faith is experiencing anaphylaxis, or to the parent,
20  guardian, or caregiver of such individual, for immediate
21  administration, regardless of whether the individual has a
22  prescription for an epinephrine injector or has previously
23  been diagnosed with an allergy; or
24  (2) administer an epinephrine injector to any
25  individual on the property of the authorized entity whom
26  the employee, agent, or other individual believes in good

1  faith is experiencing anaphylaxis, regardless of whether
2  the individual has a prescription for an epinephrine
3  injector or has previously been diagnosed with an allergy.
4  (d) An employee, agent, or other individual authorized
5  must complete an anaphylaxis training program before he or she
6  is able to provide or administer an epinephrine injector under
7  this Section. Such training shall be valid for a period of 2
8  years and shall be conducted by a nationally recognized
9  organization experienced in training laypersons in emergency
10  health treatment. The Department shall include links to
11  training providers' websites on its website.
12  Training shall include, but is not limited to:
13  (1) how to recognize signs and symptoms of an allergic
14  reaction, including anaphylaxis;
15  (2) how to administer an epinephrine injector; and
16  (3) a test demonstrating competency of the knowledge
17  required to recognize anaphylaxis and administer an
18  epinephrine injector.
19  Training may also include, but is not limited to:
20  (A) a review of high-risk areas on the authorized
21  entity's property and its related facilities;
22  (B) steps to take to prevent exposure to allergens;
23  (C) emergency follow-up procedures; and
24  (D) other criteria as determined in rules adopted
25  pursuant to this Act.

1  entity or individual conducting the training shall issue a
2  certificate to each person who successfully completes the
3  anaphylaxis training program. The Department shall approve
4  training programs and list permitted training programs on the
5  Department's Internet website.

8  Sec. 25. Good Samaritan protections. Any act or omission
9  taken in good faith pursuant to this Act by any of the
10  following entities or individuals shall be considered
11  emergency care, advice, or assistance under the Good Samaritan
12  Act: (i) an authorized entity that possesses and makes
13  available epinephrine injectors and its employees or agents;
14  (ii) an authorized individual who possesses, makes available,
15  and administers epinephrine injectors; (iii) a pharmacy or
16  manufacturer that dispenses epinephrine injectors to an
17  authorized entity or authorized individual; or (iv) an
18  individual or entity that conducts the training described in
19  subsection (d) of Section 10 of this Act.
20  Section 10. The Good Samaritan Act is amended by adding
21  Section 66 as follows:
