1  AN ACT concerning education.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Interscholastic Athletic Organization Act
5  is amended by adding Section 1.3 as follows:
6  (105 ILCS 25/1.3 new)
7  Sec. 1.3. Criminal history records check.
8  (a) An association or other entity that has, as one of its
9  purposes, promoting, sponsoring, regulating, or in any manner
10  providing for interscholastic athletics or any form of
11  athletic competition among schools and students within this
12  State shall require applicants for licensure as an official to
13  authorize a fingerprint-based criminal history records check
14  to determine if such applicants have been convicted of any
15  disqualifying, enumerated criminal or drug offenses in
16  subsection (c) or have been convicted, within 7 years of the
17  application for employment with the school district, of any
18  other felony under the laws of this State or of any offense
19  committed or attempted in any other state or against the laws
20  of the United States that, if committed or attempted in this
21  State, would have been punishable as a felony under the laws of
22  this State.

1  applicant to the association or entity, unless the applicant
2  has previously authorized the check in a prior year's
3  application through a school district, regional office of
4  education, or such an association. The association or entity
5  may require the applicant to furnish authorization for the
6  check to the regional superintendent of the educational
7  service region in which the applicant resides. Upon receipt of
8  this authorization, the appropriate regional superintendent
9  shall submit the applicant's name, sex, race, date of birth,
10  social security number, fingerprint images, and other
11  identifiers, as prescribed by the Illinois State Police, to
12  the Illinois State Police.
13  The regional superintendent submitting the requisite
14  information to the Illinois State Police shall promptly notify
15  the association or entity in which the applicant is seeking
16  licensure as an official that the check of the applicant has
17  been requested. The Illinois State Police and the Federal
18  Bureau of Investigation shall furnish, pursuant to a
19  fingerprint-based criminal history records check, records of
20  convictions, forever and hereafter, until expunged, to the
21  executive director for the association or entity that
22  requested the check. The applicant may be charged a fee not to
23  exceed the cost of the inquiry.
24  (b) The association executive or the association
25  executive's designee shall further perform a check of the
26  Statewide Sex Offender Database, as authorized by the Sex

1  Offender Community Notification Law, for each applicant. The
2  check of the Statewide Sex Offender Database must be conducted
3  by the association once every 5 years that an applicant
4  remains licensed by the association.
5  (c) The association executive or the association
6  executive's designee shall further perform a check of the
7  Statewide Murderer and Violent Offender Against Youth
8  Database, as authorized by the Murderer and Violent Offender
9  Against Youth Community Notification Law, for each applicant.
10  The check of the Murderer and Violent Offender Against Youth
11  Database must be conducted by the association executive or the
12  association executive's designee once every 5 years that an
13  applicant remains licensed by the association.
14  Pending full clearance of all background check
15  requirements, the prospective official must be supervised at
16  all times by an individual who received a qualifying result on
17  all background check components.
18  Section 99. Effective date. This Act takes effect July 1,
19  2026.
