1  AN ACT concerning safety.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Environmental Protection Act is amended by
5  changing Section 15 as follows:
6  (415 ILCS 5/15) (from Ch. 111 1/2, par. 1015)
7  Sec. 15. Plans and specifications; demonstration of
8  capability; record retention.
9  (a) Owners of public water supplies, their authorized
10  representative, or legal custodians, shall submit plans and
11  specifications to the Agency and obtain written approval
12  before construction of any proposed public water supply
13  installations, changes, or additions is started. Plans and
14  specifications shall be complete and of sufficient detail to
15  show all proposed construction, changes, or additions that may
16  affect sanitary quality, mineral quality, or adequacy of the
17  public water supply; and, where necessary, said plans and
18  specifications shall be accompanied by supplemental data as
19  may be required by the Agency to permit a complete review
20  thereof. In the case of water main installation projects, all
21  water main-related appurtenances, and specifically fire
22  hydrants and valves, shall be included in the Agency's written

1  installed in accordance with the latest edition of the Ten
2  State Recommended Standards for Water Works published by the
3  Water Supply Committee of the Great Lakes-Upper Mississippi
4  River Board of State and Provincial Public Health and
5  Environmental Managers, the latest edition of the Standard
6  Specifications for Water and Sewer Construction in Illinois
7  published by the Standard Specifications for Water and Sewer
8  Construction Committee, and the local fire code in effect for
9  the area of the proposed installation.
10  (b) All new public water supplies established after
11  October 1, 1999 shall demonstrate technical, financial, and
12  managerial capacity as a condition for issuance of a
13  construction or operation permit by the Agency or its
14  designee. The demonstration shall be consistent with the
15  technical, financial, and managerial provisions of the federal
16  Safe Drinking Water Act (P.L. 93-523), as now or hereafter
17  amended. The Agency is authorized to adopt rules in accordance
18  with the Illinois Administrative Procedure Act to implement
19  the purposes of this subsection. Such rules must take into
20  account the need for the facility, facility size,
21  sophistication of treatment of the water supply, and financial
22  requirements needed for operation of the facility.
23  (c) Except as otherwise provided under Board rules, owners
24  and operators of community water systems must maintain all
25  records, reports, and other documents related to the operation
26  of the community water system for a minimum of 10 years.
