1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Illinois Data Center Energy and Water Reporting Act.
6 Section 5. Purpose. The purpose of this Act is to ensure
7 transparency regarding the environmental impacts of data
8 centers operating within the State by requiring the disclosure
9 of energy and water usage data to the Illinois Power Agency.
10 Section 10. Definitions.
11 "Agency" means the Illinois Power Agency.
12 "Data center" means a facility used to house computer
13 systems and associated components, including
14 telecommunications and storage systems, where the primary
15 function is the storage, management, and dissemination of
16 data.
17 "Energy consumption" means the total amount of electricity
18 or other forms of energy consumed by a data center, measured in
19 kilowatt-hours.
20 "Water consumption" means the total amount of water
21 consumed by a data center, including water used for cooling,
22 measured in gallons.

1 Section 15. Reporting requirements.
2 (a) Beginning January 1, 2026, all data centers operating
3 within this State shall annually report the data center's
4 energy and water consumption to the Agency for the preceding
5 calendar year.
6 (b) The report shall include:
7 (1) the total energy consumption for the previous
8 calendar year, broken down by month and specifying the
9 energy source;
10 (2) total water consumption for the previous calendar
11 year, broken down by month and specifying whether the
12 consumption was for cooling or another application; and
13 (3) any measures undertaken the previous calendar year
14 to improve energy efficiency or reduce water usage.
15 (c) Reports shall be submitted to the Agency no later than
16 March 31 of each year.
17 Section 20. Data confidentiality and public access.
18 (a) Proprietary information may be exempt from public
19 disclosure. Aggregated and anonymized data shall be made
20 available to the public.
21 (b) The Agency shall publish an annual report summarizing
22 statewide energy and water consumption trends in data centers,
23 including, but not limited to, legislative recommendations to
24 address identified issues.

1 Section 25. Enforcement and penalties.
2 (a) Data centers that fail to comply with the reporting
3 requirements under this Act may be subject to fines of up to
4 $10,000 per violation.
5 (b) All funds collected under this Section shall be
6 deposited into the Energy Efficiency Trust Fund.
7 Section 30. Data center impact study.
8 (a) The Agency shall conduct a comprehensive study on the
9 impact that data centers in this State are having on
10 rate-paying customers.
11 (b) The study shall include, but is not limited to, the
12 following:
13 (1) the energy consumption of data centers and its
14 effects on overall electricity demand in this State;
15 (2) the extent to which data centers contribute to
16 electricity rate changes for residential, commercial, and
17 industrial customers;
18 (3) the environmental impact of data centers in this
19 State; and
20 (4) potential legislation to mitigate any negative
21 impacts of data centers on rate-paying customers.
22 (c) In conducting the study, the Agency shall:
23 (1) consult with stakeholders, including, but not
24 limited to, public utilities, data center operators,

1 consumer advocacy groups, and environmental organizations;
2 (2) analyze data from public utilities and other
3 relevant sources to assess the energy consumption and rate
4 impacts associated with data centers; and
5 (3) consider best practices from other states in
6 managing the energy and rate impacts of data centers.
7 (d) The Agency shall submit a report detailing the
8 findings of the study to the General Assembly and the Governor
9 no later than 12 months after the effective date of this Act.
10 Section 35. Rulemaking authority. The Illinois Power
11 Agency shall have the authority to adopt rules necessary to
12 implement the provisions of this Act.
