Synopsis:  Driver instructions of law enforcement procedures.
Requires the bureau of motor vehicles to include in any driver's manual
published by the bureau: (1) a description of law enforcement
procedures during a traffic stop; and (2) actions a motorist should take
during a traffic stop, including appropriate interactions with law
enforcement officers. Requires the driver education advisory board to
consult with and advise the commissioner of the bureau of motor
vehicles and the state police department regarding instruction on: (1)
law enforcement procedures during traffic stops; and (2) actions a
motorist should take during a traffic stop, including appropriate
interactions with law enforcement officers.

A BILL FOR AN ACT to amend the Indiana Code concerning
motor vehicles.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 9-24-10-3.5 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2022]: Sec. 3.5. The bureau shall include the following in any
4 driver's manual published by the bureau:
5 (1) A description of law enforcement procedures during a
6 traffic stop.
7 (2) Actions a motorist should take during a traffic stop,
8 including appropriate interactions with law enforcement
9 officers.
10 SECTION 2. IC 9-27-6-5, AS AMENDED BY P.L.85-2013,
11 SECTION 71, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
12 JULY 1, 2022]: Sec. 5. (a) As used in this section, "advisory board"
13 refers to the driver education advisory board established by subsection
14 (b).
15 (b) The driver education advisory board is established to advise the
16 commissioner in the administration of the policies of the commission
17 and the bureau regarding driver education.

1 (c) The advisory board is composed of seven (7) individuals
2 appointed by the commissioner as follows:
3 (1) Three (3) members must be driver education professionals
4 endorsed by the bureau under section 8 of this chapter. In the
5 selection of individuals for membership under this subdivision,
6 consideration must be given to driver education instruction
7 performed in urban and rural areas.
8 (2) One (1) member must be a traffic safety advocate.
9 (3) One (1) member must be a representative of the bureau.
10 (4) One (1) member must be a representative of higher education.
11 (5) One (1) member must be a representative of the insurance
12 industry.
13 (d) A member of the advisory board serves a two (2) year term. A
14 member may not be appointed to more than two (2) consecutive full
15 terms. Each member serves until the member's successor is appointed
16 and qualified.
17 (e) A member of the advisory board may be removed for good
18 cause.
19 (f) A vacancy on the advisory board shall be filled by the
20 appointment by the commissioner of an individual to fill the position
21 to which the vacating member was appointed under subsection (c) for
22 the vacating member's unexpired term.
23 (g) The advisory board shall:
24 (1) consult with and advise the commissioner in the
25 administration of the policies of the commission and the bureau
26 regarding driver education; and
27 (2) suggest rules regarding the education and training of persons
28 to operate or drive motor vehicles or to prepare a person for an
29 examination or validation for a driver's license; and
30 (3) consult with and advise the commissioner and the state
31 police department regarding instruction on:
32 (A) law enforcement procedures during traffic stops; and
33 (B) actions a motorist should take during a traffic stop,
34 including appropriate interactions with law enforcement
35 officers.
36 (h) A member of the advisory board is not subject to liability in a
37 civil action for bodily injury or property damage arising from or
38 thought to have arisen from an action taken in good faith as a member
39 of the advisory board.
