Summary of Legislation: This bill extends certain antidiscrimination educational rights statutes to prohibit
discrimination based on sexual orientation and gender identity.
Effective Date:  July 1, 2022.
Explanation of State Expenditures: The Department of Education (DOE) must ensure that the providers
they authorize do not discriminate, based on sexual orientation or gender identity, in a student’s accessability
to any course within Indiana’s course access program. The Indiana Academy for Science, Mathematics, and
Humanities (Academy) may not discriminate, based on sexual orientation or gender identity, for the purpose
of admissions. Also, the board of trustees for a state educational institution may not separate or segregate
students based on sexual orientation or gender identity. These requirements are within the routine
administrative functions of the DOE, the Academy, and state educational institutions and should be able to
be implemented with no additional appropriations, assuming near customary agency staffing and resource
levels.
Explanation of State Revenues: 
Explanation of Local Expenditures: School corporations, charter schools, and nonpublic schools accepting
Choice scholarship funding  may not discriminate, based on sexual orientation or gender identity, against any
student in terms of suspensions, expulsions, transfers, enrollment, or the separation of students. Additionally,
teachers in school corporations may not be discriminated against, based on sexual orientation or gender
identity, for the purposes of hiring, upgrading, tenure, or placement.
SB 63	1 The use or amounts of funds from the Seminary Township School Fund, provided to a student for financial
assistance, must be provided in an equitable way for every eligible student without regard to sexual
orientation or gender identity.
The requirements of this bill are within a school’s (or a Seminary Township School Fund trustee’s) routine
administrative functions and should be able to be implemented with no additional appropriations, assuming
near customary agency staffing and resource levels.
