BILL NUMBER: HB 1062	BILL AMENDED:
SUBJECT: Work Exceptions for Minors.
FIRST AUTHOR: Rep. King	BILL STATUS: As Introduced
FIRST SPONSOR:
FUNDS AFFECTED: GENERAL	IMPACT: State
XDEDICATED
FEDERAL
Summary of Legislation: The bill defines "exempted minor" for purposes of the law concerning
employment of minors. It permits certain exempted minors to work at farm labor during school hours on a
school day. It also permits certain exempted minors to work during school hours on a school day with
limitations.
Effective Date: July 1, 2024.
Explanation of State Expenditures: Enforcing child labor laws are within the Indiana Department of
Labor’s routine administrative functions and should be able to be implemented with no additional
appropriations, assuming near customary agency staffing and resource levels.
Additional Information - Federal child labor law does not allow a minor under the age of 16 to work during
school hours. In cases where federal law is more protective than state law, federal law still applies. A child
labor bulletin published by the U.S. Department of Labor regarding child labor requirements in agricultural
occupations mentions that a minor aged 14 and older may be allowed to work during school hours if they
have been excused from attending school based on religious reasons and meet the requirements of the state’s
educational attendance laws.
