Summary of Legislation: This bill removes language regarding medical passports. It relocates the definition
of "foster youth" and defines "licensed kinship caregiver". 
The bill provides that the Department of Child Services (DCS) shall not make an out-of-home placement if
the person has been convicted of a nonwaivable offense. The bill requires that, if a child in foster care
receives medical care, the person having custody of the child shall inform the provider that the child is in
foster care and require a copy of the medical treatment record be sent to the local office. 
The bill also removes the age requirement for eligibility and provides that a child who is a ward of the DCS
is considered hard to place for purposes of eligibility for state adoption subsidies. The bill also removes the
priority for funding if funds are insufficient. 
This bill also makes technical and conforming changes.
Effective Date:  July 1, 2024.
Explanation of State Expenditures: The bill makes technical changes and codifies existing practices used
by the DCS concerning the state adoption subsidy (SAS) program. 
Additional Information - This bill removes language concerning the state adoption subsidy (SAS) as the DCS
currently provides a monthly payment to families who adopt SAS-eligible children. For FY 2023, the DCS
expended approximately $10.5 M in state adoption subsidy (SAS) payments, down from $11.5 M in FY 2022
and $12.3 M in FY 2021. The DCS reports the decrease is due to state adoptions increasingly qualifying for
HB 1064	1 participation in the federal adoption assistance program (AAP). 
SAS monthly payment amounts are negotiated based on the foster care costs of the child while the child was
a ward of the state. The average negotiated monthly SAS rate was reported to be approximately $25 per day
for those SAS-eligible adoptions finalized in 2023. Over the past three calendar years, an average of 45 SAS-
eligible adoptions were finalized each year.
