Schaibley BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State DEDICATED FEDERAL Summary of Legislation: The bill Establishes the Public Safety Officer Benefit Advisory Board (board). This bill requires the State Police Department (ISP) to provide staff support for the board. It also requires the board to provide a report to the Legislative Council and Interim Study Committee on Pension Management Oversight (PMOC) before October 1 of each year. Effective Date: Upon passage. Explanation of State Expenditures: The bill will increase expenses and workload for the ISP who will provide staff support and meeting space to the board and pay the board’s expenses. Staff support from the ISP will likely be required to meet the board’s requirements to advise and assist surviving spouses, children, and parents with identifying and obtaining benefits when a public safety officer dies in the line of duty as well as to provide training to employers of public safety officers. Under current practice, when a public safety officer dies in the line of duty, the role of advising and assisting the family is performed by the employing department or by nonprofit resources. If the State Police take on that duty and there are several line-of-duty deaths, the State Police may have increased expenditures for overtime hours or may require an additional employee to assist the board. In FY 2022, 14 public safety officers died in the line of duty. If larger departments continue to provide the role of advising and assisting the families of fallen officers, current State Police staffing levels may be sufficient to support the work of the board. Ultimately, the source of funds and resources required to satisfy the requirements of this bill will depend on legislative and administrative actions. The bill creates a seven-member advisory board to gather information and provide resources relating to HB 1089 1 benefits for a public safety officer who dies in the line of duty. The board is required to meet at least annually. Three members of the board are state employees and will be eligible for reimbursement for traveling expenses and other expenses actually incurred in connection with the members’ duties on the board. The other four members of the board are not state employees and will be eligible for $100 per diem based on current rates in addition to traveling expenses and other expenses actually incurred. Additional Information - Board members include the superintendent of the ISP or the superintendent’s designee, the director of the Department of Natural Resources or the director’s designee, the commissioner of the Department of Correction or the commissioner’s designee, one county sheriff, one chief of police, one fire chief, and one paramedic or emergency medical technician.
