Culp BILL STATUS: CR Adopted - 1 st House FIRST SPONSOR: FUNDS AFFECTED: GENERAL IMPACT: State XDEDICATED FEDERAL Summary of Legislation: (Amended) The bill provides that the Department of Homeland Security (DHS) shall not inspect and operating permits are not required for certain regulated amusement devices. It provides that the DHS may perform an inspection of an exempted regulated amusement device only if a valid complaint or incident is reported to the DHS concerning the regulated amusement device. Effective Date: July 1, 2024. Explanation of State Expenditures: (Revised) The bill would reduce the workload for the Fire Prevention and Building Safety Commission to issue permits and perform on-site safety inspections for barrel trains pulled by a garden tractor and regulated amusement devices exempted from operating permit and inspection requirements by administrative rule. Revenue from the Fire and Building Services Fund is used to fund operations of the Fire Prevention and Building Safety Commission at the DHS. Additional Information - In 2022, DHS reported that amusement ride inspectors complete 1,936 amusement ride inspections in the state. These include inspections at fairgrounds, theme parks, indoor amusement parks, and ski lodges. The Indiana State Department of Agriculture reports that there are nearly 300 agritourism destinations in Indiana. Explanation of State Revenues: (Revised) The bill would reduce revenue to the Fire and Building Services Fund from annual inspection and permit fees for regulated amusement devices. Annual inspection fees under current law and regulation are $144 for a regulated amusement devise and annual amusement and entertainment permits. Inspection fees range from $99 to $272 depending on occupant load.
