Summary of Legislation: The bill requires the Indiana Department of Health (IDOH) to: (1) establish and
administer a public education program to provide information on cytomegalovirus to pregnant women; and
(2) distribute the information to specified persons. It requires a clinic or medical facility that offers fertility
care to make the information concerning cytomegalovirus available to patients of the clinic or facility.
Effective Date:  July 1, 2024.
Explanation of State Expenditures:  The bill’s requirements are within the IDOH’s routine administrative
functions and should be able to be implemented with no additional appropriations, assuming near customary
agency staffing and resource levels. [The IDOH’s administrative expenditures are currently paid from the
dedicated Tobacco Master Settlement Fund.]
Additional Information: Cytomegalovirus (CMV) is a virus that affects people of all ages. However, the
infection is more serious for babies. In the US, nearly 1 in 3 children are already infected with CMV by age
five. By age 40, over half of adults have been infected with CMV. Once CMV has been contracted, the virus
is present for life.
There are currently 13 states that require their Health Department or healthcare professionals to educate
about CMV: Colorado, Hawaii, Idaho, Illinois, Iowa, Kentucky, Minnesota, New York, New Jersey,
Tennessee, Oregon, Texas, and Utah.
Explanation of State Revenues: 
HB 1110	1 Explanation of Local Expenditures: The bill requires clinics and medical facilities that offers fertility care
to provide the information concerning CMV to their patients. Providing educational materials to patients is
within the normal administrative functions of the clinics and medical facilities.
