ENGROSSED HOUSE BILL No. 1203 A BILL FOR AN ACT to amend the Indiana Code concerning criminal law and procedure. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 35-48-4-18 IS ADDED TO THE INDIANA CODE 2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2024]: Sec. 18. (a) A person who knowingly or intentionally 4 possesses xylazine commits possession of xylazine, a Class A 5 misdemeanor. However, the offense is a Level 6 felony if the person 6 has a prior unrelated conviction under this section. 7 (b) A person who: 8 (1) knowingly or intentionally: 9 (A) manufactures; 10 (B) finances the manufacture of; 11 (C) delivers; or 12 (D) finances the delivery of; 13 xylazine; or 14 (2) possesses, with intent to: 15 (A) manufacture; 16 (B) finance the manufacture of; 17 (C) deliver; or EH 1203—LS 6290/DI 106 2 1 (D) finance the delivery of; 2 xylazine; 3 commits dealing in xylazine, a Level 5 felony. However, the offense 4 is a Level 4 felony if the person has a prior unrelated conviction 5 under this section. 6 (c) This section does not apply to one (1) or more of the 7 following: 8 (1) A person who dispenses, prescribes, or administers a drug 9 containing xylazine to a nonhuman species, if: 10 (A) the drug has been approved by the Secretary of Health 11 and Human Services under section 512 of the federal Food, 12 Drug, and Cosmetic Act (21 U.S.C. Sec. 360b); or 13 (B) the dispensing, prescription, or administration of the 14 drug is permissible under section 512(a)(4) of the federal 15 Food, Drug, and Cosmetic Act (21 U.S.C. Sec. 360b(a)(4)). 16 (2) A person who: 17 (A) manufactures, distributes, or uses xylazine as an active 18 pharmaceutical ingredient for manufacturing an animal 19 drug approved under section 512 of the federal Food, 20 Drug, and Cosmetic Act (21 U.S.C. Sec. 360b); or 21 (B) has been issued an investigation use exemption for 22 xylazine under section 512(j) of the federal Food, Drug, 23 and Cosmetic Act (21 U.S.C. Sec. 360b(j)). 24 (3) A person who manufactures, distributes, or uses a xylazine 25 bulk chemical for pharmaceutical compounding by a licensed 26 pharmacist or veterinarian. 27 (4) A person who uses xylazine for another purpose approved 28 or permitted under the federal Food, Drug, and Cosmetic Act. 29 (5) A person who: 30 (A) possesses xylazine for the purpose of engaging in an 31 activity permitted under this section; or 32 (B) delivers or transports xylazine from a person described 33 in subdivisions (1) through (5)(A) to another person 34 described in subdivisions (1) through (5)(A).
