HOUSE BILL No. 1205 A BILL FOR AN ACT to amend the Indiana Code concerning human services. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 12-29-2-16, AS AMENDED BY P.L.76-2018, 2 SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2024]: Sec. 16. (a) A community mental health center that is 4 certified by the division of mental health and addiction shall provide an 5 annual report to the division of mental health and addiction and to the 6 fiscal body and the board of county commissioners of each county 7 located in the community mental health center's primary service area. 8 The annual report under this section must include the following: 9 (1) Information concerning the operational and community based 10 activities undertaken during the year by the community mental 11 health center in each county from which the community mental 12 health center received funding under this chapter. 13 (2) A listing, by the county of patients' residence, of the following 14 information: 15 (A) The total number of patients served by the community 16 mental health center. 17 (B) The total number of patients receiving addiction treatment 2024 IN 1205—LS 6846/DI 104 2 1 services from the community mental health center. 2 (C) The total number of patients receiving mental health 3 services from the community mental health center. 4 (D) The total number of patients receiving both addiction 5 treatment services and mental health services from the 6 community mental health center. 7 (3) A copy of the most recent financial audit provided to the 8 division of mental health and addiction under 440 IAC 4.1-2-5, 9 including a balance sheet of assets and liabilities, which shall be 10 prepared by an independent certified public accountant. 11 (4) Demographic information of patients served by the 12 community mental health center. 13 (5) The total number of diagnoses served in each international 14 classification of diseases (ICD) or American Psychiatric 15 Association's Diagnostic and Statistical Manual of Mental 16 Disorders (DSM) diagnosis category that the community 17 health center provides. 18 (6) The total number of clinical encounters in the preceding 19 fiscal year. 20 (7) The total number of completed intakes in the preceding 21 fiscal year. 22 (8) The average time from initial engagement to an offered 23 initial evaluation. 24 (9) The average time from initial evaluation to an offered 25 follow-up visit. 26 (10) The community mental health center's performance in 27 comparison to the state's performance on measures identified 28 by the division of mental health and addiction, including client 29 satisfaction and clinical outcomes. 30 (11) Data related to the connection between a patient and 31 additional county or regional based services, including any of 32 the following, if available: 33 (A) Self, family, or guardian referrals. 34 (B) Law enforcement or the criminal justice system. 35 (C) A hospital or physician. 36 (D) Child or youth services, including the department of 37 child services, systems of care, or schools. 38 (E) A twenty-four (24) hour crisis intervention service. 39 (F) An enhanced call center. 40 (b) The division of mental health and addiction shall: 41 (1) specify the format of the annual reports that must be provided 42 by community mental health centers under subsection (a); and 2024 IN 1205—LS 6846/DI 104 3 1 (2) determine the measures to be used concerning 2 performance required by subsection (a)(10); and 3 (2) (3) include a summary of that information in the annual report 4 prepared by the division under subsection (c). 5 (c) The division of mental health and addiction shall annually 6 provide to the county fiscal body and board of county commissioners 7 of each county a report that includes the following: 8 (1) An overview of the total funding provided to all community 9 mental health centers during the year under this chapter, including 10 funding provided by the division for purposes of programs under 11 this chapter. 12 (2) A count, by county of residence, of the following concerning 13 patients served by the community mental health centers under 14 programs funded under this chapter: 15 (A) The total number of patients served. 16 (B) The total number of patients receiving addiction treatment 17 services. 18 (C) The total number of patients receiving mental health 19 services. 20 (D) The total number of patients receiving both addiction 21 treatment services and mental health services. 22 (3) An assessment, specified by the county of patients' residence, 23 of the overall outcomes of the treatment provided to patients of 24 the community mental health centers. 25 (4) A summary of the information provided by community mental 26 health centers in the annual reports provided under subsection (a), 27 and an explanation of the differences between the patient count 28 information provided by the community mental health centers in 29 those reports and the patient count information included in the 30 division's report under this subsection. 31 (d) The division of mental health and addiction may provide a report 32 required under subsection (c) to the county fiscal body and the board 33 of county commissioners by publishing the report on the division's 34 Internet web site. website. 2024 IN 1205—LS 6846/DI 104
