Summary of Legislation: This bill provides that in order for the child to be deemed a child in need of
services (CHINS), the parent, guardian, or custodian must consent to the care, treatment, or rehabilitation
for a child who substantially endangers the child's own health. 
It requires the juvenile court to release a child who substantially endangers the child's own health to the
child's parent, guardian, or custodian unless: (1) the juvenile court also finds the child to be a CHINS for
another reason; or (2) the parent, guardian, or custodian consents to removal of the child from the child's
home. 
It also prohibits the juvenile court from ordering that the child who substantially endangers the child's own
health be removed from the child's home unless: (1) the juvenile court also finds the child to be a CHINS for
another reason; or (2) the parent, guardian, or custodian consents to removal of the child from the child's
home.
Effective Date:  July 1, 2024.
Explanation of State Expenditures: To the extent the custodial parent does not consent to care, treatment,
or rehabilitation for their child by the Department of Child Services (DCS), this provision could affect the
workload of the DCS. 
However, the DCS may find that other facts or circumstances exist that identify the child is a child in need
of services (CHINS) and proceed with care, treatment, or rehabilitation without the consent of the custodial
parent.
