ENGROSSED HOUSE BILL No. 1337 A BILL FOR AN ACT to amend the Indiana Code concerning property. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 32-25.5-3.7 IS ADDED TO THE INDIANA CODE 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2024]: 4 Chapter 3.7. Homeowners Association Regulation of Beekeeping 5 Sec. 1. As used in this chapter, "governing documents" has the 6 meaning set forth in IC 32-25.5-2-3. 7 Sec. 2. This chapter applies only to a homeowners association's 8 adoption or amendment of governing documents after June 30, 9 2024. 10 Sec. 3. Except as provided in section 4 of this chapter, and 11 subject to section 6 of this chapter, a homeowners association may 12 adopt or amend governing documents to regulate the: 13 (1) number; and 14 (2) location; 15 of active beehives that a person may maintain on a property that 16 a person owns, rents, or leases. Sec. 4. 17 This section applies only to a person who has active EH 1337—LS 7055/DI 150 2 1 beehives located on a property before the date the homeowners 2 association adopts or amends the governing documents. This 3 chapter does not allow a homeowners association to prevent a 4 person from maintaining the same: 5 (1) number; and 6 (2) location; 7 of active beehives that are on the property before the date the 8 governing documents are adopted or amended. 9 Sec. 5. Any regulation by a homeowners association must be 10 consistent with: 11 (1) IC 14-24-8; and 12 (2) any rules adopted under IC 14-24-3. 13 Sec. 6. A homeowners association may not prohibit a person 14 from beekeeping on a property that the person owns, rents, or 15 leases if both of the following apply: 16 (1) The beehives are actively maintained for pollination or the 17 production of honey. 18 (2) The person who is beekeeping complies with: 19 (A) IC 14-24-8; and 20 (B) any rules adopted under IC 14-24-3.
