Synopsis: Recording of false liens. Makes the filing of a false lien a
Level 6 felony, and increases the penalty to a Level 5 felony if the false
lien is filed against a public official.

HOUSE BILL No. 1343
A BILL FOR AN ACT to amend the Indiana Code concerning
criminal law and procedure.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 32-28-13-10 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2024]: Sec. 10. (a) A person who, knowing or
4 having reason to know that a lien or other encumbrance:
5 (1) is false; or
6 (2) contains a material misrepresentation;
7 files the lien or other encumbrance against property owned by
8 another person commits malicious interference with property, a
9 Level 6 felony, except as provided in subsection (b).
10 (b) The offense described in subsection (a) is a Level 5 felony if
11 it is committed against a public official because of:
12 (1) an action taken or not taken by the public official within
13 the scope of the public official's official duties; or
14 (2) the public official's status as a public official.
15 SECTION 2. IC 35-52-32-1.5 IS ADDED TO THE INDIANA
16 CODE AS A NEW SECTION TO READ AS FOLLOWS
