Soliday BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED: GENERAL IMPACT: Local DEDICATED FEDERAL Summary of Legislation: This bill provides for the election and appointment of members of certain school corporations in which members of the governing body are appointed. It specifies that: (1) Three members of the governing body are appointed from a city within the school corporation; and (2) Two members are elected from the unincorporated area within the school corporation. The bill establishes a commission to nominate the candidates for the governing body. Effective Date: July 1, 2024. Explanation of State Expenditures: Explanation of State Revenues: Explanation of Local Expenditures: Governing Body: The bill provides that the governing body of a qualifying school will be comprised of two elected candidates and three candidates appointed by the fiscal body and executive of a city within the qualifying school’s boundaries. The bill also establishes the Governing Body Nominating Commission (commission) who will nominate the eligible candidates for a qualifying school corporation's governing body. Members of the commission will not be compensated, but the expenses, facilities, equipment, and supplies required by the commission to fulfill its duties will be provided by the city's fiscal body. These provisions represent a minor workload and expenditure increase for the executive and fiscal body of a city that should be able to be implemented with no additional appropriations, assuming near customary agency staffing and resource levels. HB 1360 1 Local Election Officials: Candidates seeking to be elected to the governing body must file a petition of nomination with the circuit court clerk, and candidates seeking to be nominated onto the governing body must file a petition of nomination with the clerk-treasurer. These responsibilities are within the routine administrative functions for circuit court clerks and clerk-treasurers, and should be implemented with no additional appropriations. Additional Information - Qualifying School: A qualifying school under this bill is a school corporation in which all members of the governing body are currently appointed and at least 30%, but not more than 50%, of the school corporation’s enrollment resides outside of the boundaries of a city.
