Mayfield BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State DEDICATED FEDERAL Summary of Legislation: This bill provides that the Indiana Commission for Women, the Commission on Hispanic/Latino Affairs, the Commission on the Social Status of Black Males, and the Native American Indian Affairs Commission expire June 30, 2025. The bill codifies the Serve Indiana Commission established by executive order in 2017. It authorizes the Serve Indiana Commission to study and report on topics assigned to the expiring commissions. The bill requires the Civil Rights Commission to establish four nonprofit corporations to serve as the successors in interest to the expired commissions. It specifies the powers and duties of the nonprofit corporations. It provides for the transfer of accounts, property, and records of the expiring commissions to the nonprofit corporations. Effective Date: Upon passage; July 1, 2024. Explanation of State Expenditures: Expiring Commissions: Provisions in this bill expire four commissions in FY 2026. This will reduce General Fund expenditures dependent on the amount these commissions would have been appropriated beginning in FY 2026. [These commissions received a combined appropriation of $479,000 in each of FY 2024 and FY 2025.] Nonprofit Corporations: The Indiana Civil Rights Commission (ICRC) will incur short term expenses related to establishing four nonprofit corporations. These nonprofit corporations will serve as successors to the four cultural commissions expiring under this bill. The ICRC, Indiana Department of Administration, the Serve Indiana Commission (Serve Indiana), and the State Comptroller will assist in transferring the accounts, property, and records of the expiring cultural commissions to the nonprofit corporations established in this bill. The bill’s requirements should be able to be implemented with no additional appropriations, assuming near customary agency staffing and resource levels. HB 1415 1 Serve Indiana: Serve Indiana was established in FY 2017 by an executive order. This bill codifies Serve Indiana into statute with all the same duties and responsibilities. Provisions in the bill also allow Serve Indiana to study and report on certain issues assigned to one of the expiring commissions. To the extent that Serve Indiana chooses to study and report on additional issues, its workload would increase. The Department of Workforce Development, which provides staff support to Serve Indiana, would also experience a workload increase.
