Crider BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: This bill authorizes the State Police Department (ISP) to issue an administrative subpoena to obtain certain records, if: (1) the subpoena relates to an investigation of an offense that involves the sexual exploitation of a minor; and (2) there is reasonable cause to believe that an Internet or electronic service account has been used in the sexual exploitation or attempted sexual exploitation of the minor. Effective Date: July 1, 2024. Explanation of State Expenditures: This bill could reduce the workload for ISP to issue subpoenas concerning child sex crimes. ISP indicates that currently detectives who work with the Indiana Internet Crimes Against Children Task Force (ICAC) prepare subpoenas, provide them to local prosecuting attorneys, who then file the subpoenas in front of a local judge for signature. Giving the ISP the power to issue a subpoena for these types of cases could reduce the workload for ISP. Explanation of State Revenues: Explanation of Local Expenditures: This bill could also reduce the workload for county prosecuting attorneys and judges with criminal jurisdiction.
