Synopsis: Prohibition on use of dedicated lanes. Prohibits a public
transportation project, including the blue line, from including one or
more dedicated lanes for the exclusive use of public transportation
vehicles.

A BILL FOR AN ACT to amend the Indiana Code concerning local
government.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 36-9-44 IS ADDED TO THE INDIANA CODE AS
2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE UPON
3 PASSAGE]:
4 Chapter 44. Dedicated Lanes
5 Sec. 1. This chapter does not apply to a dedicated lane for which
6 construction is completed before March 31, 2024.
7 Sec. 2. As used in this chapter, "blue line" means the
8 Indianapolis Public Transportation Corporation (IndyGo)
9 east-west bus rapid transit line primarily along Washington Street,
10 between the Indianapolis International Airport, downtown
11 Indianapolis, and Cumberland, as described and mapped in the
12 IndyGo Blue Line Rapid Transit Indianapolis, Indiana, Small
13 Starts Project Development Rating Assignment by the United
14 States Department of Transportation Federal Transit
15 Administration in November 2019. If the route is renamed or a
16 new rating assignment is submitted and it continues to be a
17 substantially similar route as compared to the November 2019

1 rating report, the definition still applies.
2 Sec. 3. As used in this chapter, "dedicated lane" means a portion
3 of a street designated by signs, markings, or other means for the
4 exclusive use of public transportation vehicles.
5 Sec. 4. As used in this chapter, "public transportation project"
6 refers to an action taken to plan, design, acquire, construct,
7 enlarge, improve, renovate, maintain, equip, or operate a public
8 transportation system.
9 Sec. 5. A public transportation project, including the blue line,
10 may not include one (1) or more dedicated lanes.
11 SECTION 2. An emergency is declared for this act.
