It specifies that certain restrictions on the local regulation of firearms, ammunition, and firearm accessories may not be construed to prevent a county, municipality, or township (unit) from regulating firearms, ammunition, or firearm accessories in a manner more restrictive than Indiana law if the regulation is recommended by a law enforcement agency of the unit and a local advocacy group that works to reduce gun violence in the community. B. It indicates particular regulations that meet these parameters. It provides that a regulation adopted by a unit must comply with the Constitution of the United States and the Constitution of the State of Indiana. Effective Date: July 1, 2024. Explanation of State Expenditures: Explanation of State Revenues: If additional court cases occur due to new ordinance violations and court fees are collected, revenue to the state General Fund may increase. The total court fee revenue per case would range between $85.50 and $103. The amount of court fees deposited will vary depending on whether the case is filed in a court of record or a municipal court. Explanation of Local Expenditures: Local units would be able to enact new ordinances to address this SB 95 1 issue. The ordinances could include the following: • the safe storage of firearms; • licenses to carry a handgun; • background checks for firearm purchases; • prohibiting the purchase of an assault weapon; • raising the minimum age to purchase a firearm to 21 years of age; or • strengthening laws concerning the seizure and retention of a firearm from a dangerous person Explanation of Local Revenues: If additional court actions occur and a judgment is entered, more revenue will be collected by certain local units. If the case is filed in a court of record, the county will receive $33.90 and qualifying municipalities will receive a share of $2.10. If the case is filed in a municipal court, the county receives $20, and the municipality will receive $33.50.
