Gaskill BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: This bill requires the Office of Judicial Administration (OJA) to compile, transmit, and publish the Public Safety and Judicial Accountability Report containing certain information about judicial officers who exercise criminal jurisdiction. Effective Date: July 1, 2024. Explanation of State Expenditures: If the OJA cannot use data currently retrievable from its Odyssey Case Management System, the OJA will incur additional staffing and reprogramming costs. It will also increase the workload for the OJA to compile and publish the Public Safety and Judicial Accountability Report. The OJA estimates that an additional 250 hours of staff time will be required per year to collect the available data. If additional reprogramming changes cannot be performed in-house, it could cost an estimated $50,000 to $75,000 to hire a contractor to implement the bill’s requirements. However, after the initial implementation, it is likely this process can be fully-automated and costs are anticipated to be minimal over the long-term. It also requires the OJA to transmit a copy of the report annually to the Legislative Council beginning November 1, 2024, and before November 1 st of each year thereafter, and publish a link to the report on their website at least 30 days prior to an election in which a judicial officer whose data is included in the report is on the ballot. Additional Information - It is unknown whether the current system contains data for each judicial officer or information regarding defendants charged with new crimes while on probation or while out on bail. As a result, the OJA may need to collaborate with the Department of Corrections (DOC), local courts, local community corrections, county probations offices, and local law enforcement agencies to retrieve data. After SB 136 1 the initial establishment of the database by the OJA, it is likely this process can be fully-automated and costs are anticipated to be minimal over the long-term. Explanation of State Revenues: Explanation of Local Expenditures: In order to implement the requirements of this bill, the OJA may request additional information from local courts. The information requested may or may not be already collected by the courts and could therefore create an increase in administrative workload.
