Summary of Legislation: This bill establishes the Prosecutor Review Board and sets forth the duties of the
board. It requires that two members appointed to the Indiana Commission on Court Appointed Attorneys be
trial court judges from counties receiving reimbursement of expenditures for noncapital cases. 
Effective Date: Upon passage; July 1, 2025.
Explanation of State Expenditures: Indiana Prosecuting Attorney’s Council (IPAC): The bill will have
no fiscal impact on the IPAC.
Explanation of State Revenues:
Explanation of Local Expenditures: Prosecutor Review Board: The bill creates a prosecutor review board
to investigate allegations against noncompliant prosecuting attorneys, with five members appointed by the
IPAC board of directors. Each member serves a four-year term and may be reappointed, but will not receive
state reimbursement for travel or other related expenses. The board shall issue a report to both IPAC and the
alleged prosecutor, and the new requirements are expected to be implemented using existing resources. 
Special Prosecutor: Any additional expenditures for the appointing county will depend on the decisions of
the prosecutor review board, the appointed judge, and the appointed special prosecutor. The county where
the noncompliant prosecutor serves is responsible for payments to the special prosecutor. The judge may
increase the scope of the special prosecutor’s duties, extend their term, appoint additional prosecutors, or
require periodic reports.
