HOUSE BILL No. 1008 A BILL FOR AN ACT to amend the Indiana Code concerning general provisions. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 1-3-3 IS ADDED TO THE INDIANA CODE AS 2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: 4 Chapter 3. Indiana-Illinois Boundary Adjustment Commission 5 Sec. 1. As used in this chapter, "commission" refers to the 6 Indiana-Illinois boundary adjustment commission established by 7 section 3 of this chapter. 8 Sec. 2. As used in this chapter, "Indiana member" refers to a 9 commission member appointed under section 4(a)(1) of this 10 chapter. 11 Sec. 3. The Indiana-Illinois boundary adjustment commission is 12 established. 13 Sec. 4. (a) The commission consists of the following members: 14 (1) Five (5) individuals who are not members of the general 15 assembly appointed by the governor. Not more than three (3) 16 members appointed under this subdivision may be members 17 of the same political party. However, if more than three (3) HB 1008—LS 7364/DI 92 2 1 individuals appointed under subdivision (2) are members of 2 the same political party, the governor may appoint the same 3 number of individuals under this subdivision from a political 4 party different from the political party of the members 5 appointed under subdivision (2). 6 (2) Five (5) individuals from the State of Illinois appointed 7 under Illinois law. 8 (b) The governor shall notify the governor of the State of Illinois 9 that the governor has appointed members to the commission under 10 subsection (a). 11 (c) The governor shall schedule the first meeting of the 12 commission not more than sixty (60) days after the governor 13 receives notice that members of the commission have been 14 appointed from the State of Illinois. At the commission's first 15 meeting, the members shall elect from the commission's members: 16 (1) the commission's chair; and 17 (2) other officers the commission considers necessary or 18 appropriate. 19 Sec. 5. (a) This section applies only to an Indiana member. 20 (b) A member of the commission serves a four (4) year term that 21 expires on June 30 of an odd-numbered year. 22 (c) A member of the commission may be reappointed to 23 successive terms. 24 (d) The governor shall fill a vacancy on the commission. An 25 individual appointed to fill a vacancy serves for the unexpired term 26 of the individual's predecessor. 27 Sec. 6. The commission shall meet at least once each calendar 28 year. The commission may meet more frequently: 29 (1) at the call of the chair; or 30 (2) if six (6) or more commission members request a meeting. 31 Sec. 7. (a) This section applies only to an Indiana member. 32 (b) Each member of the commission who is not a state employee 33 is entitled to receive the same per diem, mileage, and travel 34 allowances paid to individuals who serve as legislative and lay 35 members, respectively, of interim study committees established by 36 the legislative council. 37 (c) Each member of the commission who is a state employee is 38 entitled to reimbursement for traveling expenses as provided under 39 IC 4-13-1-4 and other expenses actually incurred in connection 40 with the member's duties as provided in the state policies and 41 procedures established by the Indiana department of 42 administration and approved by the budget agency. HB 1008—LS 7364/DI 92 3 1 (d) Per diem, mileage, and travel allowances paid under this 2 chapter shall be paid from appropriations made to the governor's 3 office. 4 Sec. 8. A quorum of the commission consists of: 5 (1) at least three (3) Indiana members; and 6 (2) at least three (3) members appointed from the State of 7 Illinois. 8 A quorum is required for official action of the commission. 9 Sec. 9. The commission's business must be conducted during a 10 public meeting held in compliance with IC 5-14-1.5. 11 Sec. 10. A writing prepared by, owned by, used by, in the 12 possession of, or retained by the commission in the performance of 13 an official function of the commission is a public record as 14 provided in IC 5-14-3. 15 Sec. 11. The governor shall designate an agency of the executive 16 branch to serve as a staff agency for the commission. 17 Sec. 12. The commission shall discuss and recommend whether 18 it is advisable to adjust the boundary between the State of Indiana 19 and the State of Illinois. 20 Sec. 13. Not later than sixty (60) days after the completion of the 21 commission's duties under this chapter, the commission shall 22 submit a written report to the general assembly in an electronic 23 format under IC 5-14-6. The report must state the following: 24 (1) A summary of the commission's work performed under 25 this chapter. 26 (2) The commission's recommendations, including any 27 legislation recommended by the commission. 28 Sec. 14. A commission recommendation to adjust the boundary 29 between the State of Indiana and the State of Illinois does not take 30 effect until approved by all of the following: 31 (1) The general assembly. 32 (2) The legislature of the State of Illinois. 33 (3) The Congress of the United States.
