Synopsis:  Notice to owner of the site of an accident. Provides that, on
or before July 1, 2026, each law enforcement agency shall adopt and
implement protocols for the law enforcement agency to notify a real
property owner of: (1) damage to the owner's real property, crops, or a
building, structure, or fixture attached to the owner's real property that
is reported to a law enforcement officer or law enforcement agency;
and (2) debris identified by a law enforcement officer or law
enforcement agency that is left on the owner's real property that could
damage farm equipment or other vehicles or property; resulting from
a motor vehicle accident.
Effective:  July 1, 2025.

HOUSE BILL No. 1012
A BILL FOR AN ACT to amend the Indiana Code concerning state
and local administration.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 5-2-26 IS ADDED TO THE INDIANA CODE AS
2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2025]:
4 Chapter 26. Protocols for Notification of Property Owners After
5 Accident
6 Sec. 1. As used in this chapter, "law enforcement agency" has
7 the meaning set forth in IC 5-2-17-2.
8 Sec. 2. As used in this chapter, "law enforcement officer" has
9 the meaning set forth in IC 5-2-1-2.
10 Sec. 3. As used in this chapter, "motor vehicle" has the meaning
11 set forth in IC 9-13-2-105.
12 Sec. 4. (a) On or before July 1, 2026, each law enforcement
13 agency shall adopt and implement protocols requiring the law
14 enforcement agency to notify a real property owner, in a time
15 frame and in a manner prescribed by the law enforcement agency,
16 of:
17 (1) damage to the owner's real property, crops, or a building,

1 structure, or fixture attached to the owner's real property
2 that is reported to a law enforcement officer or law
3 enforcement agency in accordance with
4 IC 9-26-1-1.1(a)(4)(B); and
5 (2) debris identified by a law enforcement officer or law
6 enforcement agency that is left on the owner's real property
7 that could damage farm equipment or other vehicles or
8 property;
9 resulting from a motor vehicle accident.
10 (b) A law enforcement officer or law enforcement agency is
11 immune from civil or criminal liability for failing to comply with
12 protocols established under this section, unless the noncompliance
13 constitutes gross negligence or willful or wanton misconduct.
14 SECTION 2. IC 34-30-2.1-32.7 IS ADDED TO THE INDIANA
15 CODE AS A NEW SECTION TO READ AS FOLLOWS
16 [EFFECTIVE JULY 1, 2025]: Sec. 32.7. IC 5-2-26-4(b) (Concerning
17 law enforcement notification of property owners after accident).

COMMITTEE REPORT
Mr. Speaker: Your Committee on Veterans Affairs and Public
Safety, to which was referred House Bill 1012, has had the same under
consideration and begs leave to report the same back to the House with
the recommendation that said bill be amended as follows:
Page 1, delete lines 12 through 14, begin a new paragraph and
insert:
"Sec. 4. (a) On or before July 1, 2026, each law enforcement
agency shall adopt and implement protocols requiring the law
enforcement agency to notify a real property owner, in a time
frame and in a manner prescribed by the law enforcement agency,
of:".
Page 2, after line 7, begin a new paragraph and insert:
"(b) A law enforcement officer or law enforcement agency is
immune from civil or criminal liability for failing to comply with
protocols established under this section, unless the noncompliance
constitutes gross negligence or willful or wanton misconduct.
SECTION 2. IC 34-30-2.1-32.7 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2025]: Sec. 32.7. IC 5-2-26-4(b) (Concerning
law enforcement notification of property owners after accident).".
and when so amended that said bill do pass.
