Brown L FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: (Amended) The bill specifies the persons that may file an action to obtain an injunction against an individual practicing dentistry without a license and the action that is required or allowed to be included in an injunction. The bill specifies information that a dentist who maintains a dental office must submit to the State Board of Dentistry. It states that language concerning the administration of dental anesthetics may not be construed to prohibit a physician from practicing in a dental office. The bill allows a dentist to delegate the authority to take x-ray images to a dental assistant working in certain correctional facilities without direct supervision as long as the dentist is available to supervise the dental assistant remotely. The bill removes certain language regarding the regulation of dentists. Effective Date: July 1, 2025. Explanation of State Expenditures: (Revised) Professional Licensing Agency– The Professional Licensing Agency may have a minor temporary workload increase to update the Agency’s website and notify practitioners of the changes under the bill. It is likely the Agency would be able to make any necessary changes as a routine administrative action. (Revised) Injunctions– The following persons would be allowed to bring action to obtain an injunction: (1) The Attorney General; (2) Prosecuting Attorneys in counties where the unlicensed practice occurred; (3) The Dentistry Board; and (4) County residents where the unlicensed practice occurred. It is likely this provision would clarify action filings and would not greatly affect the number of actions filed under this provision. Explanation of State Revenues: (Revised) Injunctions– It is not likely that fees from civil action filings would change significantly as a result of this provision.
