McNamara BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: The bill provides that a person convicted of: (1) rioting; (2) criminal mischief; (3) burglary; (4) residential entry; or (5) criminal trespass; committed on state property is ineligible to receive or continue receiving state public assistance, including tuition assistance, for a period of three years. It requires the Office of Judicial Administration (OJA) to establish a procedure to notify the Secretary of Family and Social Services (FSSA) and the board of trustees of a State Educational Institution (SEI) of the conviction. Effective Date: July 1, 2025. Explanation of State Expenditures: The bill provides that a person convicted of a “state property offense,” as defined in the bill, is ineligible to receive state assistance for three years from the date of conviction. This could reduce expenditures for state assistance. The number of these crimes that are committed on state property is unknown, but likely small. The bill requires the OJA to establish and administer an electronic system for receiving court convictions of state property offenses, and to make certain notifications. These provisions could increase workload for the OJA but should be able to be implemented using existing staffing and resources. Explanation of State Revenues: Explanation of Local Expenditures: The bill requires a court to determine whether an individual has committed a state property offense. If the court determines that the individual has committed this offense, the court is to advise the individual of the consequences, and a judge is to report any positive determination of this offense using the OJA electronic reporting system.
