Synopsis:  Medicaid coverage for treatment of obesity. Requires
Medicaid coverage for the treatment of obesity, including specified
services and medication approved by the federal Food and Drug
Administration. Requires written notice regarding the coverage to be
provided annually to Medicaid recipients, providers, and prescribers.
Effective:  July 1, 2025.

HOUSE BILL No. 1202
A BILL FOR AN ACT to amend the Indiana Code concerning
human services.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 12-15-5-22 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2025]: Sec. 22. (a) As used in this section, "office" includes the
4 following:
5 (1) The office of the secretary of family and social services.
6 (2) A managed care organization that has contracted with the
7 office of Medicaid policy and planning under this article.
8 (3) A person that has contracted with a managed care
9 organization described in subdivision (2).
10 (b) The office shall provide coverage for the treatment of obesity
11 that includes the following:
12 (1) Prevention and wellness services.
13 (2) Nutrition counseling.
14 (3) Intensive behavioral therapy.
15 (4) Bariatric surgery.
16 (5) Any medication approved by the federal Food and Drug
17 Administration for chronic weight management.

1 (c) Criteria for coverage of a medication described in subsection
2 (b)(5) shall not be more restrictive than the indication for the
3 medication approved by the federal Food and Drug
4 Administration.
5 (d) The office shall provide a Medicaid recipient unrestricted
6 access (as defined in IC 12-15-35.5-2.5) to a medication described
7 in subsection (b)(5).
8 (e) This section does not preclude the Medicaid program's use
9 of utilization management to determine the medical necessity for
10 treatment of obesity under this section if the appropriateness and
11 medical necessity determinations are made in the same manner as
12 the determinations for the treatment of other illnesses, conditions,
13 or disorders covered by the state Medicaid plan.
14 (f) Not later than January 1, 2026, and every January 1
15 thereafter, the office shall provide written notice to recipients,
16 providers, and prescribers concerning the coverage for the
17 treatment of obesity described in this section.
