Summary of Legislation: The bill requires a petition of nomination for a school board office to state one
of the following: (1) The candidate's political party affiliation. (2) If the candidate does not identify with a
political party, that the candidate is an independent candidate. (3) That the candidate elects to be listed on
the ballot as nonpartisan. The bill specifies that unless a candidate that states a political party affiliation is
challenged, the candidate's statement must be indicated on the ballot.
Effective Date: Upon passage.
Explanation of State Expenditures: The provisions of the bill would likely require the Election Division
to update some manuals and forms for the 2026 (and later) school board elections which should be able to
be changed as a matter of routine business. However, the petitions of nomination (and its instructions) for
school board candidates for the 2026 election would need to be updated prior to candidates receiving
signatures. For the last general election, petitions for school board candidates were filed between May 21,
2024, until noon June 20, 2024.
Explanation of State Revenues:
Explanation of Local Expenditures: County election officials would need to change ballots to include party
and non/party affiliations for school board candidates for the 2026 general election and subsequent elections.
These changes should be able to be accommodated as part of routine election ballot preparation and
programming prior to elections.
(Revised) Local election authorities would need to be able to program their ballots to be able to distinguish
between the school board candidates and other offices for purposes of straight ticket voting. If counties
voting machines cannot make the distinction, counties may need to use paper ballots for school board office
voting.
