HOUSE BILL No. 1240 A BILL FOR AN ACT to amend the Indiana Code concerning state offices and administration and to make an appropriation. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 5-16-16 IS ADDED TO THE INDIANA CODE AS 2 A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 3 1, 2025]: 4 Chapter 16. Grant Program for the Installation of Lactation 5 Rooms in Public Buildings 6 Sec. 1. This chapter applies to a public agency. 7 Sec. 2. As used in this chapter, "authority" refers to the Indiana 8 housing and community development authority created by 9 IC 5-20-1-3. 10 Sec. 3. As used in this chapter, "fund" refers to the lactation 11 room grant fund established by section 10 of this chapter. 12 Sec. 4. As used in this chapter, "grant program" refers to the 13 grant program for the installation of lactation rooms established 14 by section 7 of this chapter. 15 Sec. 5. As used in this chapter, "lactation room" means a room 16 designated and equipped for the purpose of allowing mothers to 17 nurse or express milk in a clean and private setting within a public 2025 IN 1240—LS 6036/DI 92 2 1 building. 2 Sec. 6. As used in this chapter, "public agency" has the meaning 3 set forth in IC 5-30-1-11. 4 Sec. 7. The grant program for the installation of lactation rooms 5 is established to provide grants to public agencies to offset costs 6 incurred in the installation of lactation rooms when constructing 7 or renovating public buildings. 8 Sec. 8. (a) The authority shall administer the grant program. 9 The authority shall do the following: 10 (1) Adopt guidelines to determine standards for awarding 11 grants under this chapter, including standards for 12 determining whether a lactation room complies with section 13 9 of this chapter and any other applicable governmental or 14 other nationally recognized standards that apply to the 15 provision of lactation rooms in public buildings. 16 (2) Prepare and supervise the issuance of public information 17 concerning the grant program. 18 (3) Prescribe the form for and regulate the submission of 19 applications for grants under this chapter. 20 (b) A public agency may apply in the manner prescribed by the 21 authority for a grant under this chapter to offset costs incurred in 22 the installation of a lactation room in a public building managed by 23 the public agency. 24 Sec. 9. A lactation room installed by a public agency that 25 receives a grant under this chapter must meet the following 26 standards: 27 (1) The space must be shielded from view and free from 28 intrusion of others. 29 (2) The room must be functional, with a private space with a 30 place to sit and a flat surface, other than the floor, to place a 31 breast pump and other supplies. 32 (3) The room must provide the following: 33 (A) Access to electricity for the use of a breast pump. 34 (B) Good lighting. 35 (C) A comfortable temperature. 36 (D) Proper ventilation. 37 Sec. 10. (a) The lactation room grant fund is established to 38 provide grants under this chapter. The authority shall administer 39 the fund. 40 (b) The fund consists of: 41 (1) money appropriated to the fund by the general assembly; 42 (2) money received from state or federal grants or programs 2025 IN 1240—LS 6036/DI 92 3 1 for the purposes of this chapter; and 2 (3) donations, gifts, and money received from any other 3 source, including transfers from other funds or accounts. 4 (c) The treasurer of state shall invest the money in the fund not 5 currently needed to meet the obligations of the fund in the same 6 manner as other public funds may be invested. 7 (d) Money in the fund at the end of a state fiscal year does not 8 revert to the state general fund but remains in the fund to be used 9 exclusively for purposes of this chapter. 10 (e) Money in the fund is continuously appropriated for the 11 purposes of this chapter. 12 SECTION 2. [EFFECTIVE JULY 1, 2025] (a) There is 13 appropriated from the state general fund five million dollars 14 ($5,000,000) to the Indiana housing and community development 15 authority for deposit in the lactation room grant fund established 16 by IC 5-16-16-10, as added by this act, for the period beginning 17 July 1, 2025, and ending June 30, 2026. 18 (b) This SECTION expires January 1, 2027. 2025 IN 1240—LS 6036/DI 92
