Synopsis:  Home and community based services waivers. Requires the
office of the secretary of family and social services to apply to the
United States Department of Health and Human Services for an
amendment to each home and community based services Medicaid
waiver to exclude the income and resources of a spouse when
determining an individual's eligibility for the waiver.
Effective:  July 1, 2025.

HOUSE BILL No. 1262
A BILL FOR AN ACT to amend the Indiana Code concerning
human services.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 12-15-1.3-18.5 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 18.5. (a) Before September 1,
4 2025, the office of the secretary shall apply to the United States
5 Department of Health and Human Services for an amendment to
6 each home and community based services Medicaid waiver to
7 exclude the income and resources of a spouse when determining an
8 individual's eligibility for a home and community based services
9 Medicaid waiver.
10 (b) The office of the secretary shall implement the changes in
11 determining eligibility for a home and community based services
12 Medicaid waiver specified in subsection (a) beginning on the date
13 on which the United States Department of Health and Human
14 Services approves the request for changes by the office of the
15 secretary under this section.
