Synopsis:  Employment social enterprises. Defines "employment social

criteria. Amends the definition of "workforce related program" to
include a work based learning program or transitional jobs program
that: (1) is through an employment social enterprise; and (2) meets
certain other criteria.
Effective:  July 1, 2025.

HOUSE BILL No. 1289
A BILL FOR AN ACT to amend the Indiana Code concerning labor
and safety.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 22-4.1-1-3.5 IS ADDED TO THE INDIANA
2 CODE AS A NEW SECTION TO READ AS FOLLOWS
3 [EFFECTIVE JULY 1, 2025]: Sec. 3.5. "Employment social
4 enterprise" means a nonprofit or for-profit organization that:
5 (1) provides:
6 (A) transitional employment; and
7 (B) social support, including on-the-job and life skills
8 training;
9 to individuals with a barrier to employment, as defined in
10 Section 3(24) of WIOA (29 U.S.C. 3102(24));
11 (2) uses evidence based practices and data driven policies to
12 inform decision making, implement procedures, and measure
13 outcomes; and
14 (3) does one (1) or more of the following:
15 (A) Provides services.
16 (B) Produces goods.
17 (C) Assembles goods.

1 SECTION 2. IC 22-4.1-1-7, AS AMENDED BY P.L.106-2024,
2 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2025]: Sec. 7. (a) Except as provided in subsection (b),
4 "workforce related program" means:
5 (1) a program operated, delivered, or enabled, in whole or in part,
6 by a state provider using public funds to offer incentives, funding,
7 support, or guidance for any of the following purposes:
8 (1) (A) Job training.
9 (2) (B) The attainment of an industry recognized certification
10 or credential.
11 (3) (C) The attainment of a postsecondary degree, certificate,
12 or credential.
13 (4) (D) The provision of other types of employment assistance.
14 (5) (E) The promotion of Indiana to workers or the provision
15 of assistance to a worker relocating to Indiana for employment.
16 (6) (F) Any other program that:
17 (A) (i) has, at least in part, the goal of securing employment
18 or better employment for an individual; and
19 (B) (ii) receives funding through WIOA or a state
20 appropriation; or
21 (2) a work based learning program or transitional jobs
22 program that is:
23 (A) through an employment social enterprise; and
24 (B) operated, delivered, or enabled, in whole or in part, by
25 a state provider using public funds.
26 (b) For purposes of IC 22-4.1-24-3, "workforce related program"
27 means a program offering incentives, funding, support, or guidance for
28 any of the following purposes:
29 (1) Job training.
30 (2) The attainment of an industry recognized certification or
31 credential.
32 (3) The attainment of a postsecondary degree, certificate, or
33 credential.
34 (4) The provision of other types of employment assistance.
35 (5) The promotion of Indiana to workers or the provision of
36 assistance to a worker relocating to Indiana for employment.
37 (6) Any other program that has, at least in part, the goal of
38 securing employment or better employment for an individual.
39 The term does not include an apprenticeship program for which
40 funding is received under IC 22-4-25-1(c).
