Andrade BILL STATUS: As Introduced FIRST SPONSOR: FUNDS AFFECTED:XGENERAL IMPACT: State & Local DEDICATED FEDERAL Summary of Legislation: This bill requires each school corporation and charter school to develop a plan to conduct developmentally appropriate evidence based: (1) Mental health screening; and (2) Substance use disorder screening; for students in kindergarten through grade 12. The bill also establishes notification, consent, and data destruction requirements. The bill requires the Department of Education to make available to school corporations and charter schools developmentally appropriate evidence based mental health screening and substance use disorder screening tools and resources. Effective Date: July 1, 2025. Explanation of State Expenditures: Provisions in the bill require the Department of Education (DOE) to consult with the Division of Mental Health and Addiction (DMHA) to select the screening tools and other resources that will be made available to public schools. The impact to state workload and/ or expenditures is ultimately dependent on the screener or tools adopted by DOE and DMHA for use in public schools. To the extent that the agencies can utilize existing resources from the School Health Assessment and Performance Evaluation System’s Screening and Assessment Library to find free or low-cost screening and assessment tools, expenditures can be minimized. Additional resources and federal funds may also be available from the Substance Abuse and Mental Health Services Administration. Explanation of State Revenues: Explanation of Local Expenditures: Beginning in FY 2026, public schools will experience a workload increase to implement the mental health and substance use disorder screeners adopted by DOE and DMHA.
