HOUSE BILL No. 1315 A BILL FOR AN ACT to amend the Indiana Code concerning general provisions. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 1-1-9-1 IS AMENDED TO READ AS FOLLOWS 2 [EFFECTIVE UPON PASSAGE]: Sec. 1. (a) The following are legal 3 holidays within the state of Indiana for all purposes: 4 New Year's Day, January 1. 5 Martin Luther King, Jr.'s Birthday, the third Monday in January. 6 Abraham Lincoln's Birthday, February 12. 7 George Washington's Birthday, the third Monday in February. 8 Good Friday, a movable feast day. 9 Memorial Day, the last Monday in May. 10 Juneteenth, June 19. 11 Independence Day, July 4. 12 Labor Day, the first Monday in September. 13 Columbus Day, the second Monday in October. 14 Election Day, the day of any general, municipal, or primary 15 election. 16 Veterans Day, November 11. 17 Thanksgiving Day, the fourth Thursday in November. 2025 IN 1315—LS 6074/DI 107 2 1 Christmas Day, December 25. 2 Sunday, the first day of the week. 3 (b) When any of these holidays, other than Sunday, comes on 4 Sunday, the following Monday shall be the legal holiday. When any of 5 these holidays comes on Saturday, the preceding Friday shall be the 6 legal holiday. 7 (c) This section does not affect any action taken by the state, the 8 general assembly while in session, or a political subdivision (as defined 9 in IC 36-1-2-13). Any action taken by the state, the general assembly, 10 or a political subdivision on any such holiday shall be valid for all 11 purposes. 12 SECTION 2. IC 15-17-5-12, AS ADDED BY P.L.2-2008, 13 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE 14 UPON PASSAGE]: Sec. 12. (a) Except as provided in subsection (b), 15 the board is not required to furnish meat or poultry inspection under 16 this chapter: 17 (1) for more than eight (8) hours in one (1) day; 18 (2) for more than forty (40) hours in one (1) calendar week; or 19 (3) on Saturdays, Sundays, or the following legal holidays: 20 (A) New Year's Day. 21 (B) Washington's Birthday. 22 (C) Memorial Day. 23 (D) Martin Luther King, Jr. Day. 24 (E) Juneteenth. 25 (E) (F) Columbus Day. 26 (F) (G) Independence Day. 27 (G) (H) Labor Day. 28 (H) (I) Veterans Day. 29 (I) (J) Thanksgiving Day. 30 (J) (K) Christmas. 31 (b) If the operator of an establishment under inspection pays to the 32 board an hourly fee for each hour of state meat or poultry inspection 33 furnished: 34 (1) more than eight (8) hours in one (1) day; 35 (2) more than forty (40) hours in one (1) calendar week; or 36 (3) on Saturdays, Sundays, and legal holidays; 37 the board shall furnish the inspection service. 38 (c) Subject to the approval of the budget agency, the board shall 39 establish an hourly rate for overtime at an amount sufficient to defray 40 the cost of the inspection service. The establishment shall reimburse 41 the board not later than thirty (30) days after assessment for overtime 42 or legal overtime fees collected under this chapter. All overtime fees deposited with 2 the treasurer of state under this subsection are appropriated to the 3 budget agency for allotment to the board for the administration and 4 enforcement of this chapter. 5 (d) The board may assign inspection personnel to more than one (1) 6 establishment in order to efficiently use board personnel and resources. 7 SECTION 3.
